UPDATE (5:10pm) — A jury has found a Pensacola woman guilty of first degree murder after she sat on her 9-year-old cousin and killed her in October of 2017.
Veronica Posey has been sentenced to life in prison.
Pensacola, Fla (WKRG)- The jury is now deliberating in the trial of a Pensacola woman accused of sitting on her 9-year-old cousin and killing her in October of 2017.
It’s day two of the trial of Veronica Posey, who faces a felony murder charge in the death of 9-year-old Dericka Lindsay. Posey is just one of the family members charged, including the aunt and uncle James and Grace Smith.
Posey is around 320 pounds and allegedly sat on 9-year-old Lindsay because she was out of control.
The State would like Posey to face a felony murder charge. In the State’s closing arguments, it claims Posey was enraged at Lindsay’s behavior and wanted to discipline her. The State referred to the home that Lindsay lived in with the Smith’s as the “house of horrors”. The State says in the 9-1-1- call made by Posey on the day of Lindsay’s death, she told the operator she did not sit on Lindsay. The State says that is inconsistent with what actually happened.
The State also says Posey sat on Lindsay who was around 100 pounds and continued to sit on Lindsay even after she said she could not breathe.
Posey’s attorney claims this all was a terrible accident and there’s no proof that Posey was mad or enraged at the time.
The state spoke about the beatings Lindsay received with a belt by Grace Smith. The prosecutor said Posey held Lindsay down while Smith hit her with a belt around ten times. The state also said Lindsay struggled for her life while Posey sat on her. The prosecutor says Posey sat on Lindsay for around five to six minutes.
Posey’s lawyer told the jury there was no evidence Posey was trying to kill Lindsay. Posey’s lawyer asked the jury for a not guilty verdict.
