Plant City couple sued in foreclosure lawsuit for a home they never owned

PLANT CITY, FL (WFLA) -

Leticia Castillo-Ortiz was stunned to be sued by SunTrust Mortgage. The bank claimed they owed more than $180,000 on a Tampa town home and that they had stopped making mortgage payments.

She and her husband, Luis Cruz, say they've never owned a home and rent a house in Plant City.

They've never even seen the Tampa townhouse that SunTrust mortgage is taking back in foreclosure.

"Never, I don't even know my way around Tampa," Castillo-Ortiz said.

According to the lawsuit, Cruz had owned the home with another man and had stopped paying the mortgage. Both his wife and his mother, who lives in New Jersey, were named in the lawsuit.

Castillo-Ortiz says she called the bank, gave her husband's social security number and was told it must be a case of mistaken identity.

"The social security numbers didn't match up," Castillo-Ortiz said. "So I was told that me and his mother would be cleared of everything and they would drop everything."

But that didn't happen. Instead, she received a summons to appear in court this week.

So, she called 8-On-Your-Side, and we contacted the bank. Spokesman Hugh Suhr sent an email that the bank had "escalated" the issue and would contact the family quickly to resolve the issue.
