Plains Southcap Files Response To MAWSS

Two weeks ago the Mobile Area Water and Sewer System filed a motion to dismiss a lawsuit by Plains Southcap.  Today the pipeline company filed its response.  Lawyers for the company contend MAWSS has been aware of the plans to build a pipeline near the city’s water supply since November of last year.  In the filing, Plains says in a February meeting this year MAWSS expressed no objection to the location of the pipeline.

You can read the entire filing here.  The real test comes Thursday morning in probate court.  Judge Don Davis is set to hear arguments on the case.  MAWSS is being sued by Plains through eminent domain so the company can acquire the last piece of land it needs to finish building the controversial project.
