No sign of Rep. Mitchell in Montgomery

MONTGOMERY, Alabama -

Legislators are in the middle of a spirited session in Montgomery, as they work to hammer out an education budget.

But Mobile is lacking representation. Joseph Mitchell has not showed up at the capitol at all this session and has not cast one vote, all while still drawing his legislative salary of close to $55,000 dollars.

His colleagues say right now there isn't much that can be done about it.

"I don't know what we can do about it. Legislatively right now there is no type of penalty or anything that I know of so I am really not sure where we need to go there, whether we need to legislate some type of penalty for not coming to work," said Rep. David Sessions of Mobile.

Voters will ultimately have the final say to decide if they want someone else to fill Mitchell's seat. He is up for re-election in 2014.
