A state agency that regulates mining companies says a Foley dirt pit could be too close to a busy roadway- possibly creating a dangerous situation.
The Alabama Dept. of Labor's Mining Division is investigating the Layco Mining Pit on Fern Avenue operated by RLF Baldwin Properties.
The dirt pit appears to be less than 50 feet from the roadway.
State law requires mining pits to be at least 50 feet from a road.
Drivers that use Fern Avenue on a regular basis tell News 5 the pit is too close to the road.
People living on Fern Avenue say they've watched the pit grow in size over the past several years.
We tried to contact Brooks DeLaney- the owner of the pit- but our attempts to reach DeLaney were unsuccessful.
The overflow was caused by Monday night’s heavy rainfall.
