BAY MINETTE, Alabama -

Private businesses and corporations are allowed to test employees for drugs- but in Alabama- some government workers are exempt from taking drug tests.

Government employees that hold safety sensitive jobs- like police officers, equipment operators and construction workers- are given pre-employment and random drug tests.

But under state law- testing government workers not in a safety sensitive position violates the 4th Amendment- which protects against unreasonable search and seizure.

Baldwin County Commission President Tucker Dorsey wants all county employees to be drug tested.

Commissioner Dorsey says fellow commissioners are in favor of across the board testing...but the proposal will likely be a dead issue because of state law protecting 4th Amendment rights of government workers.
