"He clearly wasn't going to cause anybody harm, which was evident, he didn't do anything, he was asleep when they busted through the glass," says Adam Gambino.
Gambino admits his brother was intoxicated and unstable but says police did not have to use a SWAT team or shut down the city to end the standoff.
"I know my brother and know what he's not and I certainly thought it was drastic measures that were taken. I felt from the very beginning that I could've walked in there with a key and opened the door and went in there and talked to him and took him home."
Richard's father, Rick Gambino, agrees.
"They went a little overboard in my opinion," says Rick. "It could've been handled very easily, nobody knows our son, my son and his brother better than we do."
Fairhope Police Chief Terry Sanders says the situation was too volitale to let family members talk to Gambino. Sanders tells News 5 sending in the tactical unit was their only option in regards to everyone's safety.
Richard Gambino was arrested and charged with reckless endangerment. He will spend a week at a local psychiatric hospital.
