BREAKING: No charges in deadly shooting of one-year-old

MOBILE, Ala (WKRG) - UPDATE: According to Mobile Police there will be no charges filed in the case. The evidence was presented to the Mobile County DA's office who affirmed there was no probable cause to press criminal charges.

MOBILE, Ala. (WKRG) - Mobile Police say the one-year-old boy who was shot at a home in West Mobile has died. 

According to MPD, the one-year-old was shot at home on the 8000 block of Domain Street near Three Notch Road Monday afternoon.

Mobile Police Chief Lawrence Battiste says the mother of the one-year-old was home at the time of the shooting, but had gone out back to a "mother in law" suite in the back part of the house to let the grandmother know she was leaving. 

Police say a two-year-old was also home at the time of the shooting and that the two-year-old told his mother of the shooting by saying his "ears were ringing." Police say the gun, possibly a 9mm, was in the parents' bedroom. 

The one-year-old was brought to Providence Hospital, according to police.  

It is unknown how he was shot. 

News 5's Mary Smith spoke with neighbors who say they heard a gunshot and someone screaming. They said they rushed over to help a little boy who they say was shot in the back.

Chief Battiste said at least four children live in the home.
