BREAKING NEWS: WASHINGTON (AP) - The Supreme Court has cleared the way for
Alabama, Mississippi and Texas to set new execution dates for three
inmates who were granted last-minute reprieves by the justices last
year.
The court on Monday turned down appeals from Thomas Arthur of Alabama, Earl Wesley Berry of Mississippi and Carlton Turner of
Texas. The court blocked their executions last fall while it
considered a challenge to Kentucky's lethal injection procedures.
The justices said those procedures are not unconstitutionally
cruel, a decision that almost certainly will lead to a resumption
of executions after a 7-month hiatus.
The high court's last-minute orders temporarily sparing the
three inmates automatically expired when the justices denied their
appeals Monday.
Arthur was sentenced to death for the 1982 killing of Troy Wicker of Muscle Shoals.

The court appointed attorneys tried to take themselves off of the case citing their lack of experience in these kinds of matters, and were denied. Also, 2 of the 3 lawyers didnt even get to talk to Arthur until the day of the trial. READ MY LINK CARL!!

Are you saying he could not have a lawyer or that he could not have a free lawyer to file his appeals ? Just asking in an attempt to understand it better. It would seem a family member or a friend would help if it was a matter of money for the lawyer.

KMLG apparently hasnt been reading or keeping up with the case. The only thing that ties Arthur to the murder of Troy Wicker is a CONVICTED FELONS testimony. Thats it. In fact, many of the jury members said that if they had been presented with all of the facts that we now have, they would have found him innocent. This isnt just a case of ones rights being completely taken away, it is a box belonging to Pandora. It can and will set a precedent that convicted felons, truly innocent or not, have no right to appeal or to have their investigators investigate the courts evidence. Every person reading this should be worried. If you are not, your either ignorant or apathetic. And in these times, we need not be either.

i’m sorry that you and your family are having to deal with this but it sounds like Mr. Arthur didn’t have a good attorney.  the bible says you have to live by the law of the land, and if one of my family members rapes or murders someone then they have to pay the price for their actions because the bible says so.  if Mr. Arthur is truly innocent then those who have sentenced him to death wrongly then God deal with them on judgement day.

Thomas Arthur will be the first inmate to die without his first Habeas Corpus Review. The United States Supreme Court just ruled suspected Terrorists have the right for Habeas Corpus reviews. The United States Supreme court ruled in Nov 2007, Arthur did not have the right to have crime scene evidence DNA tested. They never even reviewed his appeal. HIs paper work was filed late. In Alabama you are not entitled to an attorney during the post conviction appeals(habeas corpus) So with no lawyer, his appeals were filed late. The crime scene evidence if DNA tested could prove Arthur was never at the crime scene. Most assume he is guilty. The state will say he has exhausted all of his appeals. the truth is they have never been heard, DNA evidence, witnesses, phone records showing he was somewhere else when the murder was committed. DNA evidence includes a rape kit, blood samples, hair and much more. Thomas Arthur is being legally murdered. So unless you are a suspected terrorist, you have no constitutional rights in our judicial system. Do we really want to run our Judical system in this manner. The United States Supreme Court should be ashamed they are allowing this to happen in the United States of America. Do you kno what it feels like to sit with your father right before his execution and know theere is DNA evidence that could prove his innocence? I do and have done it 2 times now. July 31,2008, will be my 3rd time. Is this closure for the victims family. They even want the Crime scene evidence DNA tested.
Most of you that write do not know what is really going on in our judicial system and we are kiling innocent people. Just hope it never happens to you.....

i use to work for DOC and i know what most of them are on death row for and the majority of them are for taking other’s life and a jury convicted them.  so i don’t have to check out anything.  let me correct myself the death penalty is for taking a life out of malice but some are on death row for life w/out b/c of the court system over turning the death sentence b/c of their age.
