Dexter Ford, who has told police he is HIV-positive, also is charged with felonious assault.
The woman is a 23-year-old student at the University of Cincinnati.
The Hamilton County prosecutor says the woman woke up during the attack along a highway and fought back but couldn't get away. He says the woman has epilepsy and this wasn't the first time she had wandered outside while asleep.
Ford's lawyer says the accused had no way of knowing the woman was sleepwalking. As he puts it, was it "a dream `yes' or a real `yes?"'
The prosecutor says the woman did not consent to sex and anyone who saw her in her sleepwalking state should have been able to tell something was wrong.
