Brian Bates was convicted of second degree rape in 1995. As a convicted sex offender, Bates is required to notify police anytime he moves. This time he didn't and now we know why.
Police say Bates was living in a home on County Road 26 near Saint Benedict's School. The home is also near a daycare center. According to state and federal law, convicted sex offenders are not allowed to stay or live near daycares and schools.
Bates was charged with violating the Sex Offender Community Notification Act. Bond was set at $5,000.
