The Daphne City Council approved a citywide no smoking ordinance Monday night.
However, there are some exceptions.
The air quality ordinance, as it was called, would ban smoking in all enclosed public places, job sites and seating areas of stadiums as well as within 20 feet of outside main entrances.
Some people speaking before the council thought the ordinance should be even tougher.
One person said, "Bars are the worst perpetrators of second hand smoke. As for bars, may I suggest the following: no smoking in bars, no exceptions."
Still another said, "I can't stress the importance of having a strong ban. It does no good to just do a partial ban."
However, the council voted to allow smoking in bars and designated hotel and motel rooms.
Later, the council voted to hire six additional firefighters for the city, despite concerns by mayor as to where the money will come from for these hirings as well as for future projects.
Fire Chief Bo White said he was "ecstatic" about the move.
But Daphne Mayor Fred Small said, "I will agree with the chiefs, we need more men on the truck. But the intent for this is to put a station in this area (near City Hall) just because, all of a sudden, we've had one house fire and, all of a sudden, we've figured out that one station that's been a volunteer station is not operated all the time or there's nobody there."
The City Council also voted to raise the salary of the mayor from $60,000 a year to $75,000 a year effective next election.


Smoking and second-hand smoking kills by causing lung cancer, this is science.  I have nothing against smokers, it’s your choice to light up.  Personally, I don’t want to die of lung cancer, this is a preventable disease. In public buildings where smoking is allowed I am forced to breathe in toxic second-hand smoke.  We wouldn’t need no-smoking laws if smokers would please respect the health concerns of others and smoke outside.  However, with my experience in Daphne, this usually doesn’t happen.

This should be fought all the way to the supreme court in my opinion. The government has NO right whatsoever to tell me or anyone where they can or cannot smoke. This merely gives them a stepping stone to take away more rights and more liberties from us. I completely and totally understand the owners of a business making rules about smokers in their businesses. But the government? No. Don’t the have more important things to do? I am a non-smoker, but that doesnt mean that I dont care about other peoples rights. Non-smokers tend to treat smokers like diseased people. You could get hurt more by the polution in the air in some cases than second hand smoke.
Go ahead and let resturuants and businesses decide for themselves whether they do or do not want to let smoking happen in their resturaunts. But get the government out of the picture. This is not their place, they might as well ban sex toys.... oops wait… they all ready did that too.

As I mentioned, the ban on outdoor smoking is debatable in my opinion.  There’s lots of free air outside and I don’t mind people smoking in a parking lot.  However smoking indoors (which it sounds like you don’t and is appreciated) is a totally different story and needs this kind of ban.  I don’t actually live in Daphne, but will now be driving from Saraland to dine there since I know I will be able to eat without suffering due to allergies.  So they will also be gaining some business as well maybe losing some.  Like I said, the outdoor thing is maybe going too far, so no offense there.

Dear Opinionwriter,
I have not smoked inside a public place since the 1980’s.  That seems not to please you guys either.  Fairhope has gone as far as to say that you can’t even smoke in a public parking space.  Smokers need to shop too and shopping takes time when you are spending money.  Protecting the public and isolating one sector of the population is mean spirited and I will not spend money in Daphne if you go to extremes.  I haven’t blown smoke on one soul inside your city.  Didn’t the State of Alabama file a suit against the cigarette companies for damages done to us, yet smokers couldn’t get a free pack of gum or a patch even after they claim it was on our behalf.  Instead, they increased the cost of cigarettes so that we can further be isolated.  I’d rather they had made the tobacca companies create a brand of cigarettes that reduces the addictive qualities of a cigarette three months at the time, as in staged, about the same way they addicted so many boomers unknowingly.

Our “Liberty” is often protected by rules that govern the actions of us all.  This rule happens to protect nonsmoking citizens from second-hand smoke, which is a known carcinogen.  Do you obey the speed limit?  Is that an infraction on your liberty?  You can’t drive 120mph because it could kill someone.  Smoking might not kill as fast as a speeding driver, but it just might kill the single mom restaurant worker trying to make a living serving the public.  As far as the 20 ft ban, maybe that’s debatable, but not the indoor rules.

I will no longer shop in Daphne.  You have nothing that I can’ t buy in Foley, Robertsdale, or Bay Minette.  My tax monies can go to people who do not try to overly contol people.  As long as tobacca is not a controlled substance, you are far reaching and meddling in the lives of other people.  I have already stopped flying, eating out, and shopping in malls.  Food stores where the last place that I could go and Walmart in Daphne will lose all of my business, and also the oil change people, and the car detail people, and the furniture stores that have such beautiful display windows, they won’t see me walking outside them looking at their goods either.  I do not hand my liberty over to anyone, then reward them for taking it.
