JACKSON, Miss. (AP) - Attorneys for a condemned death row inmate
say the state of Mississippi shouldn't be setting execution dates
for condemned inmates until a decision is reached on whether death
by lethal injection is cruel punishment.
Assistant Attorney General Marvin White Junior asked the
Mississippi Supreme Court on Monday to set an execution date for
Earl Wesley Berry.
The Mississippi court has not ruled on the request.
In a response filed yesterday (Thursday) with the court,
attorneys with the Mississippi Office of Capital Post-Conviction
Counsel said other states have delayed executions until the lethal
injection issue is settled.
Berry's attorney, Robert Ryan, said the U.S. Supreme Court's
decision to consider the constitutionality of a lethal injection
procedure similar to that used in Mississippi is sufficient for a
stay of execution.
He said without a final decision the setting of an execution
date for Berry was premature.

Lethal injection is to good for most of these type’s of animals. Not to mention too costly, a bullet to the head would be a better way to spend my tax dollars.

Mississippi has laws in place that says lethal injection is not cruel. Berry killed an innocent lady that was leaving choir practice. The manner in which he killed her was beyond cruel and unusual. I cannot begin to imagine what this lady must have been thinking during her ordeal. He said he was not going to “rape” her and told her he would take her back to town. Instead, he took her to another wooded area and beat her until she died of blunt force trauma. He confessed to this crime and led investigators to her body. There should be NO stay. IMO, he is getting the easy way out.
