MOBILE, Ala. (AP) - A federal court jury rejected claims thatformer Mobile County Sheriff Jack Tillman retaliated against a
black officer who filed a racial grievance against him three years
ago.
The all-white federal jury ruled in Tillman's favor yesterday on
two main questions presented during three days of testimony in a
civil trial.
The jurors determined that Tillman's decisions to suspend and
then transfer Corporal Jimmie Gardner were legitimate. They also
rejected claims that Tillman created a racially hostile work
environment by repeatedly using a racial slur.
Tillman, who is white, denied that he had ever used the epithet,
and several sheriff's employees testified they never heard Tillman
say anything racist.
Gardner, who was seeking lost pay and damages for mental
anguish, expressed frustration with the verdict.
