DULUTH, Minn. (AP) - The driver of a car that struck and killed
a dog is suing the dog's owners for damage done to his vehicle.
Jeffery Ely was driving near Duluth, Minnesota, on January 4th
when Fester, a miniature pinscher, ran into the road. Ely's 1997
Honda Civic struck Fester, killing the 13-pound dog instantly.
Now Ely is suing Fester's owners for about $1,100 for damage to
his car, time he had to take off from his two jobs to get the car
repaired, and court fees.
Ely tells Duluth News Tribune he feels sorry for the family's
loss but feels they must be responsible for their pets' actions.
He's a dog owner himself.
Fester's owners have countersued Ely, for $2,400.

I was listening to the radio this morning wabb screwy news and this story made it… supposedlly the dog messed up his radiator!

That’s ok MERCEDES,I hear it’s going around,They’ll probably have the whole county Quarantined before it’s over. that foot in the mouth can be a bad thing,I’ve had it a few times myself.

dear MERCEDES… wrong on all counts.  i’ve spent most of my life deeply involved in the world of dogs.  everything from rescue work, placement, showing, obedience competition, lure field trials to grief counciling for bereaved pet owners, plus thirteen years as a canine control officer, and am now retired.  so..i know from where-ith i speak-ith.  also darlin’, i’m not a southern gentleman.  actually i’m a die-hard new england yankee lady, still involved in pet rescue.  the only “obviousness” in this man’s initiated suit is its complete assininity and frivolity.

In all likelihood the speed limit in that neighborhood is 25mph or less.  If he had been doing the limit, he should of had ample time to stop his car before hitting the dog.  Even if he could not stop in time for some extraneous reason, he should not have done much more than roll over the pet with his tires.

It would be in the interest of the pet owners to photograph the accident scene and demonstrate the probable speed at which this careless individual went careening down the roadways putting pets and children at risk of severe injury or death.

I still remember a story that must have taken place over thirty years ago.  A young woman and her grandmother went to her graduation ceremonies at USM.  While driving back the girl swerved to miss a turtle crossing the road, lost control and sent the car tumbling out of control.  Killed both of them on what should have been one of their happiest days.  Never take that risk.

Very well kept dogs and cats will dash out of a fenced yard or home in the blink of an eye and accidents can happen.  I just can’t believe that little dog caused much damage to the car, plus if it can be shown this guy was speeding through that neighborhood the degree of negligence would become shared.  If I was the dog owner I would make it very hard on this guy just because he decided to grind salt into an open wound.

i was intending this issue to die a peaceful death.  however, after reading some comments i felt i simply had to respond. firstly, MERCEDES, you aren’t by any chance an attorney, are you??  please don’t give this man any more ideas,hes’s doing fine on his own.
secondly, BAMABOB, i agree.  a quick trip to bebos would have fixed this mans problem.  i just didn’t want to be crass.  unfortunately, incidents such as happened to your moms dog do happen. neither party was guilty.  however, most of these accidents occur due to the negligent pet owner who knowingly allows his animal to roam at large.
thirdly, SOUTHFAN, good thinking.  never swerve to avoid hitting an animal. it’s your first instinct and very hard not to do, but swerving can cause disastrous damage, not only to your vehicle but to yourself as well.  do not slam on the brakes either.  there may be another car immediately behind you or cause you to lose control .  ease up on the accelerator and say a quick prayer..........
