2 Miami teens arrested after using stun gun on woman and raping her. Teens Charged With Rape

MIAMI (AP) - A 13- and 15-year-old have been arrested after they
broke into a woman's home, jolted her with a stun gun and raped her
while her baby was sleeping nearby.
Miami Police say the teens confessed and were charged with armed
sexual battery, armed burglary, kidnapping, and armed robbery.
Police said the 21-year-old woman heard a knock on her front
door on May 23, but ignored it. She later noticed the door was ajar
and when she turned, she was hit in the back with a Taser. The
teens took her into one of the bedrooms, covered her face with a
shirt, and raped her.
The victim begged for her life and the life of her child who was
in a nearby bedroom. The infant was not harmed.
The Associated Press is not naming the suspects because of their
age. The State Attorney's Office has not yet determined whether
they will be charged as adults.

Yes, I misstated my last comment. Capital Homicide (murder) is distinguishable from other forms of homicide, but homicide is still homicide. Both are felonies, but the severity of the punishment varies.

Look e here BOB… As in relation to ALABAMA criminal law ... The crime of MURDER IS A SPECIFIC CRIME and is totally seperate from the crime of Vehicular Homocide. How can murder not be a specific crime??? 13A-6-2 is the SPECIFIC CRIME OF MURDER. Not to be confused with that of VEHICULAR HOMOCIDE which is 32-5A-192. If they were the same crime, they would be under the same statute and called the same…but they are NOT THE SAME. If murder is not a specific crime as you say….you better call the attorney generals office and let them know that so the law can be removed from the books and anyone that is in prision, charged with MURDER..can be released ASAP…B/C they were not charged with a SPECIFIC crime.

Murder is not a specific crime. It is a degree of homicide that can be due to intentional malice, or reckless behavior.

You said “but in Alabama if a teen with a lead foot runs off the road and someone dies she is automatically charged as an adult for the crime of murder.“ You stated something that was not accurate..you said she was charged with murder…when she WAS NOT. Remember I said LEGALLY speaking. Murder is a specific crime….totally different than vehicular homocide…Both have their own specific elements.

Yes, they should be tried as adults. The questions is why isn’t that an automatic procedural thing for such a heinous crime?

Wrong case, wrong city…moving on to this story. Trying to figure out if these kids should be tried as adults??? Hell yes! They did things that normally adults do (Bad adults do I should say). They knew what they were doing and went ahead and raped this woman.
What is wrong with these kids today? Oh, I know the answer to that one, it’s the parents. Or, they could blame tv for their trouble’s. Either way, they knew what they were doing and YES, they should be charged as adults.

I’m referring to the local story about the 16-year-old girl that has been charged as an adult for the crime of vehicular homicide (murder).

In most criminal situations there are conditions that have to be met before it is determined that a minor will be charged as an adult. However, in Alabama it is apparently an automatic response to certain crimes.
