DULUTH, Minn. (AP) - The driver of a car that struck and killed
a dog is suing the dog's owners for damage done to his vehicle.
Jeffery Ely was driving near Duluth, Minnesota, on January 4th
when Fester, a miniature pinscher, ran into the road. Ely's 1997
Honda Civic struck Fester, killing the 13-pound dog instantly.
Now Ely is suing Fester's owners for about $1,100 for damage to
his car, time he had to take off from his two jobs to get the car
repaired, and court fees.
Ely tells Duluth News Tribune he feels sorry for the family's
loss but feels they must be responsible for their pets' actions.
He's a dog owner himself.
Fester's owners have countersued Ely, for $2,400.

I think you guys are missing the point. Maybe he had a special air spoiler made out of solid gold, I don’t know. The fact is this dog was on the road and caused an accident, period. Let’s say instead of hitting the dog, the driver was to cross over into oncoming traffic and hit a pick-up truck pulling a trailer full of innocent Bit Bull puppies. How would you feel now? Why do people think their dog has the right to run loose and leave dog dirt in their neighbors front yard? That is so disrespectful!!! What kind of owner would allow their dog to run loose in traffic? I guess it’s the same people that spend thousands having a vet put a dog back together again so he can live the rest of his life with arthritis, until he gets hit again and dies.

Relax, no Pit Bulls were injured during the writing of this blog.

I TOTALLY AGREE...AS A FORMER CANINE CONTROL OFFICER (13YEARS) I HAVE NEVER, EVER SEEN ANY DAMAGE WHATSOEVER CAUSED BY A 13 LB. ANIMAL. IT APPEARS THAT THIS ‘PERSON’ HAS HAD PREVIOUS DAMAGE TO HIS VEHICLE AND IS TRYING TO COLLECT ON THAT. ABSURD!!. MISSING WORK???? GOOD GRIEF!!! NEXT HE WILL BE ATTEMPTING TO SUE FOR ANGUISH AND WHIPLASH. ANY JUDGE THAT WOULD CONSIDER THIS ‘CASE’ AND AWARD THIS ‘PERSON’ ANY MONIES NEED TO TURN IN HIS GAVEL!

I had one of those for about 11 years before she died and I’ve never had a more loving or caring animal of any kind. She weighted about the same too,and she couldn’t have done $11 worth of damage much less $1100,unless she would have jumped up and scratched the paint on the door trying to get in the car to go somewhere.Sounds like he had a previous accident and is looking for donations to repair his auto.

I don’t think a 13 pound dog could do that much damage to a vehicle. And I definately think this guy is absurd for wanting to be imbursed for missing work. Show me a picture of the damage!!!! I wanna see how much damage the pooch put him through.
