Driver of car that struck and killed dog sues dog owners Dead Dog Lawsuit

DULUTH, Minn. (AP) - The driver of a car that struck and killed
a dog is suing the dog's owners for damage done to his vehicle.
Jeffery Ely was driving near Duluth, Minnesota, on January 4th
when Fester, a miniature pinscher, ran into the road. Ely's 1997
Honda Civic struck Fester, killing the 13-pound dog instantly.
Now Ely is suing Fester's owners for about $1,100 for damage to
his car, time he had to take off from his two jobs to get the car
repaired, and court fees.
Ely tells Duluth News Tribune he feels sorry for the family's
loss but feels they must be responsible for their pets' actions.
He's a dog owner himself.
Fester's owners have countersued Ely, for $2,400.

You wouldnt believe the damage I did to a POS Dodge Colt avoiding a dog in the road. I will not swerve again! Cats, squirrels, possums, dogs, NOPE, I will not swerve. If you don’t care about your pet, cat or dog enough to keep it leashed or inside, then I dont either.

Kind of like a 54 million dollar pair of pants?

My mom had a little Spitz and he dashed out of a gate as mom was trying to bring in a bag of groceries and went straight into the street and got hit by a car.  It broke her heart and really upset the guy that ran over the dog.  The only damage that guy might of had was a red stain on one of his tires.

Accidents happen and all of them do not need to end up in court.

Look, the guy has damages and by the time it’s all said and done, the money he’s awarded wont measure up to the time he has spent getting his car fixed and going to the court house. Most would just eat it instead of going through all the frustration, but I hope he is teaching the dog’s owners a new trick, that they need to take better care of their pets.

A frivolous lawsuit would be this guy claiming that he has post traumatic stress disorder and can’t make love to his wife because he has flashback of running over this poor innocent creature every time he tries to get intimate… and is claiming one million dollars in damages. This could actually happen. Lawyers have to buy gas too.

I can see my 100 lb puppy doing a grand or more worth of damage, but not a min pin!I’d love to see this guys paperwork on his losses.

How much time did he have to take off? It would take me a half hour to go drop the car off, another to pick it up, and I’m sure somebody would show compasion and give me a ride to work.

I hit a Boxer (50-75 lb dog) in a ‘98 Altima going 50mph a few years ago, and the dog’s owner paid to replace my bumper (less than $500). I can’t imagine how a tiny little dog could do so much damage unless it was like sucked up into the engine, which wouldn’t actually happen!

I AM VERY SORRY YOU HAVE MISSED THE POINT OF MY COMMENT.  I ADDRESSED THE ISSUE OF THE MANS FRIVOLOUS SUIT...NOT THE ISSUE OF RESPONSIBILITY.  OF COURSE THE OWNER IS RESPONSIBLE.  THE LAWS PERTAINING TO DOGS ARE QUITE CLEAR.  YOUR DOG(S) MUST BE KEPT UNDER CONTROL AT ALL TIMES.  THIS CONTROL MAY BE VIA THREE METHODS.....FENCING, LEASH OR VOCAL, (NOT RECOMMENDED UNLESS YOUR DOG HAS UNDERGONE STRICT OBEDIENCE TRAINING).  OBVIOUSLY, A DOG RUNNING IN THE ROAD IS NOT UNDER CONTROL, ERGO IN VIOLATION OF A STATE STATUATE.  I BELIEVE THIS LAW IS UNIVERSAL AND NOT INDIGINOUS TO ONE AREA IN PARTICULAR. PAY ATTENTION FOLKS, YOU HAVE TOTALLY MISSED MY POINT.  LET US HAVE A WORST CASE SCENARIO.  THE DOG IS RUNNING LOOSE IN THE ROAD.  A CHILD COMES ALONG RIDING HIS BIKE...THE DOG RUNS IN FRONT OF THE CHILD....THE CHILD SWERVES AND TRIES TO AVOID HITTING THE DOG AND IN DOING SO TURNS INTO THE PATH OF AN ONCOMING CAR.  NEED I GO ANY FURTHER??? I HAVE SEEN IT HAPPEN , THE CONSEQUENCES ARE DISASTEROUS.

Well he is suing for lost wages and court fees in that $1,100 so the total damage to the car was not $1,100.  But, how does Festers owner have the nerve to counter-sue.  Just by chance if they show up they will be awarded something.  And, for what being an irresponsible pet owner.
