$1.5 million or his kidney back. That's the strange ultimatum a New York surgeon has given his estranged wife.

Dr Richard Batista donated his kidney to his wife Dawnell in 2001. His attorney claims that she began having an extramarital affair a couple of years after the transplant. She filed for divorce in 2005.

Dr. Batista decided to go public after four years of divorce negotations. He wants the donated kidney back, but will accept $1.5 million in compensation.

Mrs Batista and her attorney had no comment on the suit.

The couple has three children, ages, 8, 11 and 14.

i think he is really smart.  wow, what a payback. love it. she is the idiot, a good husband, a million dollar home, what a dope she was. not to mention those 3 children. i think she should give the kidney back. that operation is so painful to the donor, let her lover donate.

I hope none of his patients make him mad just before surgery!  gulp

I could take his side at one point because if an ex does you wrong most times you want to get back at them any way that you can.  He made a statement of the reason he donated the kidney to her in the first place. {“She was my wife. My priority was to save her life, save her life and future of our children and hopefully with that in mind keep the marriage alive,” Dr. Batista said.}

She is still the mother of his children so why would he want to take the kidney away from her (if he actually could) now. He would still be hurting the children whether he was married to her or not.

On another note, it’s illegal for an organ to be exchanged for anything of value. Organs in the United States may not be bought or sold.

Donating an organ is considered a gift. Maybe he should have made her sign a pre-kidney agreement that if they divorced she would lose her kidney. smile

That is a little extreme.  I can see liberal visitation rights, but…....

what an idiot
