"We don't use the outside anymore because being outside is no longer pleasant," says Joyce Hutchinson.
The Hutchinson's say the track, which is located on Horseshoe Bend Road east of Loxley, is loud, dirty and is damaging to their health.
"When I breathe in the dust, I go to my knees," says James Hutchinson. "I start gagging and losing my breath. The dust kicked up from those A-T-V's and from the motorbikes is rough."
"I have allergies and my health has gone done since we've lived here. When we first moved here, this was just a field. Now, the owner has expanded and added to the track."
The Baldwin County Planning and Zoning Commission says the track is "not" illegal and says the property owner hasn't violated any zoning regulations. The Hutchinson's say they've hired an attorney and say they'll sue the property owner.
News 5 spoke to Debra Henning, the owner of the track Wednesday. Henning says they've lived in the area for 20 years and say they will not close the track.

Ok I wake this morning & what is the first thing I see on the news. Another person complaining about ATV’s. We ride everything weekend. Most of the time it is family oriented. And keeps our kids out of trouble. There could be a farmer next door like the rest of Baldwin County. With big tractors that go ALL day long. Tilling up dust & crop dusters flying over. Number one. They moved down here. These people that ride ATV’s. I am sure the people riding have lived here all their life. Also I am sure that if this couple that is complaining are big race fans. They are not going to mind coming over to Mobile County to watch the races at the new Motor sports track that is going to cause lots of noise. But you don’t hear that many complaining about that. They are complaining about ruining their retirement. Well we are complaining cause the are trying to ruin our fun. Thats what retirement communities are for. This is the first I have heard about this track. So thanks for the advertisement.
