James and Joyce Hutchinson moved to Baldwin County from North Alabama in 2006, but the couple says a motorsports track across the street is destroying their retirement.

"We don't use the outside anymore because being outside is no longer pleasant," says Joyce Hutchinson.

The Hutchinson's say the track, which is located on Horseshoe Bend Road east of Loxley, is loud, dirty and is damaging to their health.

"When I breathe in the dust, I go to my knees," says James Hutchinson. "I start gagging and losing my breath. The dust kicked up from those A-T-V's and from the motorbikes is rough."

"I have allergies and my health has gone done since we've lived here. When we first moved here, this was just a field. Now, the owner has expanded and added to the track."

The Baldwin County Planning and Zoning Commission says the track is "not" illegal and says the property owner hasn't violated any zoning regulations. The Hutchinson's say they've hired an attorney and say they'll sue the property owner.

News 5 spoke to Debra Henning, the owner of the track Wednesday. Henning says they've lived in the area for 20 years and say they will not close the track.

Wow, lmao, I can’t believe the complaints people make about kids and teens doing something constructive with their time! They could be out digging graves to make a bong. Or they could be out dealing and doing drugs and robbing folks. But NO, they want to participate in a legal, fun hobby, and people want to complain. I think it’s sad, maybe the Hutchinsons need to pack and go back to NORTH Alabama. Rather than trying to close down a track, and have the kids trespassing on peoples property, and tearing up terrain they have no business being on. I think Alabama should be more lenient on ATV riders, and make public trails, ATV Lanes along highways, and parks for them. Then maybe more young kids and teens would be able to ride, and stay out of trouble.

And if they don’t want to deal with it, then they should MOVE!

These old people need to get a life and get over it! At least these kids are doing something good instead of being out on the streets doing Lord knows what! Sounds to me like these old people are just big complainers that need something to complain about. Damaging to their health? PLEASE! The wind can blow up more dust when it hasn’t rained in a while! Riding dirt bikes and 4wheelers is a great thing for kids to do as a hobby. This old couple needs to just deal with it and let these kids have a good time!

i say let them ride, the old people should just leave everyone alone, i think they should be the ones in trouble for lieing

Live and let live! You know, if you don’t like your neighbors you can always MOVE! I’m sure someone who likes to ride would like to have a track conveniently next door.

I have known the hennings for atleast 6 years and that track has been there much longer than three years, there are only usually 3 but no more than 5 or 6 at a time.  I am a neighbor and I was never asked to sign a petition and I dont think we have 12 houses on the block not to mention the ones that can’t even see or be bothered by it.  The neighbors a set so far back into the yard that they can’t possibley be too bothered because someone that I know lives very close and isnt all that bothered by it of course its noisey but they arent out there for more than an hour, and it takes longer to mow the lawn which is noisy and kicks up dust too..  talk about nucent neighbors!  they are the trouble I think!  not to mention the hennings tried several times to reason with them and talk to them and try to compromise, If you ask me I dont want that sort of behavoir in my neighborhood!

i thank the hennings for providing a place that his kid and friends to stay out of trouble i bought a used fire truck to hose down the track to keep down the dust but it did not make them happy the kids do wear helmets neckbraces chest protectors goggles and riding boots

I usually ignore these types of issues.  I am only posting a comment in support of the Hennings who own this property where the track is located.  They live in the county in an area that was recently zoned.  This dirt track was in existance long before any implemented zoning.  The neighors who are complaining will never be happy.  They need to move somewhere else.  If you have problems breathing, why did they move out in the county where there are lots of fields and the potential for dust?  Until recently, Horseshoe Bend was a dirt road.  This dirt track is for pleasure and is not a business to those concerned about this issue.  There will always be things about neighbors that people do not like.  Therefore, my advice to the unhappy neighbors is to move somewhere that will be beneficial for your health.  The Hennings are not breaking any laws, and harassing the Hennings should not be tolerated either.

I say

“Crank her up, ride her hard” get her muddy” and to the retired people...you were young once too.....if you want to retire.......I hear Florida has some nice spots available.
