A warrant was issued for Summar Marousky arrest when she checked herself out of the hospital in the middle fo the night.
On a day set aside to remember officers who died in the line of duty, one Sheriffs deputy, fighting for his life, is on everyone mind.
"Andy is having a great day today. Andy is off the ventilator in fact he's actually been able to talk," according to Sheriff Hoss Mack.
Ashton was injured in a near head on collision ten days ago. The driver of the other car was driving down the wrong way of Highway 59. Now she's being charged with assault but no one knows where she is.
"The only thing that we have been able to determine is essentially approximately at one a.m. She was no longer in that hospital," according to Baldwin County District Attorney Judy Newcomb.
Summar Marousky had been in a Florida hospital recovering from her injuries. "We had initiated negotiations with her family to attempt to turn her in upon her discharge from the hospital. Last night those negotiations broke down and we were told to follow the legal process," says Newcomb.
That process involves getting a fugitive warrant for her arrest.
"I think it's very unfortunate that it has come to this point." It might be unfortunate but Sheriff Mack says the D.A.'s office is doing the right thing. "We're pleased that the charges and the investigation have moved forward and it's time now to take it to the next level and Ms Marousky will have her day in court."
If convicted of assault, Marousky could spend as much as twenty years in prison.
