Man Accused of Hitting a 5-Year-Old Found Guilty

Joshua Smith has been charged with negligent vehicular homicide by a jury in a Mobile courtroom this afternoon. The jury found him not guilty of leaving the scene of an accident with injuries. Smith stood trial after being accused of hitting 5-year-old J'Lexus Lee. Lee was hit and killed by Smith's oncoming car at the intersection of Kennedy and Congress Streets last Mardi Gras. Toxicology reports showed Smith was not under the influence of alcohol or drugs that day.

this was a very tragic event for all involved,and regardless of what happened today in court,nothing will bring back the little girl.if the accussed is sentenced to a long prison term,may he use that time to think on his actions and of the pain he has caused.they all need our prayers.

As horrible as this is. I feel really bad for the guy. Do you have any idea how much adrenalin was most likely pumping through his system at the time this happened. Its human nature, when our adrenialin runs, this is what we do. I am sure everyone says “well if I did that I would have stopped regardless.” But would you? Seriously, what is controlling you at the moment? Adrenalin. Some people react differently, unfortunately he ran. So now, a great person who made a mistake is behind bars… possibly for years to life. It is amazing how 2 seconds can change the course of your life forever.

Okay, they found him not guilty of leaving the scene. He had no drugs or alcohol in his system. So please tell me how he can be convicted of negligence? I understand a little girl was tragically killed and I am very upset about that.

I guess I wasn’t in the courtroom to hear all the evidence.
