ATLANTA (AP) - The battle over Florida's presidential primary
has come to federal court in Atlanta.
A lawyer for a Democratic party activist from Tampa told a
three-judge panel Monday that the party's decision not count the
delegates from the state violates his constitutional rights. Victor
DiMaio's lawsuit was dismissed earlier by a federal judge in
Florida.
The 11th U.S. Circuit Court of Appeals agreed to hear an
expedited appeal.
The Florida Democratic Party argues that DiMaio lacks standing
to bring the suit.
The lawsuit could have big repercussions in the excruciatingly
close race for the Democratic nomination between Barack Obama and
Hillary Rodham Clinton. Officials in Florida are wrestling with how
- and if - to hold a revote. The state had its 210 convention
delegates stripped as punishment for moving its primary up to
January 29th, against the wishes of the Democratic National
Committee.
