cleared the two-year college system's new policy barring system
employees from holding elected office.
But the department also says in a letter sent today that
lawsuits could still be filed later to challenge the policy.
Christopher Coates is acting chief of the department's voting
section and informed two-year Chancellor Bradley Byrne of the
department's decision today.
The policy against so-called "double dipping" needed to be
cleared by the federal department under the 1965 Voting Rights Act
before because it affects legislators who have been elected to
office.
Byrne says the decision in favor the policies was anticipated
but he's not sure when they can be enforced.
The state board of education passed the much-debated policy last
August. They also approved a policy on leave and flex time that
could force nine legislators to choose between their system jobs
and their duties in the House and Senate.
