Patients of a Dauphin Island medical clinic say their privacy was violated when a town employee went into their doctor's office with a video camera. Sandi and Tommy Sands say a copy of a surveillance video from their doctor's office was left on their porch last week but they don't know by who. The Sands say a filing cabinet in Doctor David Jenkins' office was videotaped. They claim their private medical records and other patient records are inside the cabinet. Dauphin Island's mayor confirms a town employee did videotape inside the doctor's office. But, the mayor says they were only protecting the town's interest, "we had some concerns. We didn't know at the time; we'd lost contact with him and we had heard rumors which obviously concerned us. So, we through our attorneys, felt like the best thing we could do, cause the building does belong to the town of Dauphin Island, a lot of the equipment inside the building belongs to the town, and we just felt like, again through our attorneys request, that videotaping the interior of the building was the right thing to do at the time," said Dauphin Island's Mayor Jeff Collier. But that explanation just isn't good enough for the Sands, "what I want done, is those people that are responsible, to answer to the town. I want in the case of my medical records, I want federal charges brought, I want an investigation done," said patient, Sandi Sands. Mayor Collier also says he's been told by town attorneys no privacy rights were violated. We contacted Dr. Jenkins with Island Health Care and his attorney, but they did not have a comment for our story.

the town was afforded many opportunity to resolve the issue. the town has made promises to a packed room (12/4/07) and with days, reneged on ALL of them. The mayor has given multiple reasons for the break-in, none of them ever the same. Council member Tafra who was present at the break-in denied by omission at the council meeting to having any knowledge of the break-in, although he was one of three people present. The town denied making the tape until they were confronted with proof they were lying.
When council members could not answer the public questions and the lawyer they deferred EVERY question to, got called on inaccuracies and often blatant lies that would elicit shocked gasps from an entire room of people (he was just that arrogant or ignorant, we’re not sure which).
