Can Lam Luong get a fair trial in Mobile County?

That's the question attorneys discussed in court as they get closer to trying the man charged with 5 counts of capital murder.

Luong is the man police say tossed his four young children off the Dauphin Island Bridge in January 2008.

It took search crews two weeks to pull all four bodies from the water.

Ryan, Hannah, Lindsey and Danny were all laid to rest together in Bayou La Batre.

Police say Luong originally confessed to the crime and later pleaded not guilty in court.

Luong's trial date is set for March 9, 2009.

The question now is... where will the trial be held?

The defense wants to put their finger on the pulse in Mobile County and would like to conduct a phone survey to determine how much people know or remember about the case.

A research expert named Dr. Verne Kennedy was brought to court on Wednesday. He submitted a rough draft on the survey.

350 random calls could be made to potential jurors in Mobile County.

Here are some sample questions.

1. Have you heard, read or seen anything about the Lam Luong case?

2. Have you talked to family members about the Lam Luong case?

3. Is it your personal and private opinion that Lam Luong is guilty or not guilty?

Another draft on the survey is expected to be submitted next week.

Mobile County District Attorney John Tyson believes the case can be tried here. "We have had a number of high profile cases tried in Mobile County and those cases have withstood appellate court scrutiny. So yes, I think it's possible."

Wherever the trial will be held, it's expected to last up the 3 weeks.

Judge Charles Graddick also decided that the jury would be sequestered during that time.

Evertime I read about this I think of those precioius children.  They did not deserve what happened to them.  I personally think that they should hang him to the side of the Dauphin Island Bridge and have the trial there or maybe we will get lucky and they will put him in the general population in the jail house and someone else will take care of him and then our tax dollars do not have to feed this monster anymore!!!!!

The Constitution was written by humans for humans. In my opinion this thing has none of the attributes to qualify as human, and should be treated as a dangerous animal that will kill with little or no provocation and no regard to whom his victims are.

If I were chosen for that jury, they would just have to keep stacks of boxes of tissues in front of me. It would be so difficult to hear about these babies and what they would have gone through at that time. My heart would be aching for them. As in all cases, this man is innocent until proven guilty. This case will be a very difficult one for the jury no matter where the hearing takes place.

Like I said, thank God for constitutional guarantees. He deserves to submit a defense, prove mitigating circumstances and be sentenced appropriately. I do not know how anyone will be able to listen to a defense and not think about those children being tossed over the concrete sides of that bridge. Who knows what it takes for a parent to harm their children? What is in a mother’s mind when she boils water then sticks her kid’s feet in them because that child won’t stop screaming? Why do parents whip for behavior and cross the line to leave red, raw lines, popping up in welts? Why do parents light themselves on fire cooking Meth and burn their kids in the next room as well? Who knows?

Amen to not playing GOD! But in this case I think I would play JUDGE, JURY and executioner and send him on his way to be judged by GOD.

It sure is haunting and I can hear their cries for mama or daddy as each went over the side and hit the water. This thing is a monster and should be treated as one.

The question is does he deserve a fair trial? IMO, I don’t think he does, he deserves to be taken in front of a firing squad and obliterated, it sounds inhuman but he can’t possibly have a heart to do what he did…

I used to think I could be impartial in cases like this. However, I drove over the Dauphin Island bridge a few times this week and thought about his crime each time. I thought about those children who had to be confused and probably scared. I thought about how he had to pull his car over, put it in park with intent and take each one separately to drop them over. The water is too beautiful to accept that curse. I do not think I could extinguish the image of the water glistening with each splash.
