Are cash Poker Games Leagl?

With the popularity of "The World Series Of Poker", this pastime has become one of the fastest growing forms of entertainment. In Baldwin county there are many cash games being held at private clubs (VFW,
Elks, etc). There are also "Poker Leagues" at public bars. There is a prize tournament being held at the Top of the Bay in Daphne this saturday, December 1. The top prize at this tournament is a 52" TV and the grand prize for league play is a seat at "The World Series of Poker".

I'm not a lawyer (thank God), but I believe cash games are legal if there is no rake, which is when the house takes a percentage. If there is a rake, then it would mean you're running the game, rather than merely hosting the game.

There is still some debate on whether poker is a game of chance, or a game of skill. I suspect eventually it will be ruled a game of chance and made illegal. I believe this because law enforcement has so few murders are robberies to solve and needs something to fill their days cracking down on. Also, the state runs dog tracks and hates it when you compete with its self-appointed gambling monopoly.
