A quick stop at a local Wal-Mart store ends with a father, James Miley, Jr. and his mother, Allison Miley going to jail after leaving a five month old little boy locked in a car for almost an hour in the Foley Wal-Mart parking lot.
"It was an accident," James Miley told News Five as he was being led into the Foley Police Department.
Allison Miley called it a mistake, "I ran in for ten minutes in Wal-Mart forgot he was there."
"The child is five months old," says Lt. David White, "There's absolutely no excuse for someone to leave a child in a vehicle no matter what age the child is. A juvenile child, an infant like this there's absolutely no excuse."
A security officer on routine patrol of the parking lot spotted the child. He called police who later had the owners of the car paged. They never responded to the in store page and were later arrested in the check-out line.
Both James Miley, Jr. and Allison Miley faced a municipal court judge in Foley Tuesday afternoon and plead guilty to endangering the welfare of a child and was given a 180 day suspended sentence and will serve 30 days in the Foley Detention Center.

And the apple don’t fall far from the tree. If you want to know your prospective partner, take a good long look at their family.

Angie1973 – That is what I thought, the mother of this baby is the one out working to support him, while the dad could care less!! My thoughts and prayers are with the baby and mother this Holiday Season.

Hopefully, the mother will see this as a wake up call, and she will seek better arrangements for child care!

Why does it matter where the mother was?? I know this family, and the mother is the only one who works! That’s where she was! The grandmother and the father were the one’s responsible for the baby! The father is only 18 and the grandmother has mental problems, so personally I don’t think either one of them are fit to take care of this child!! Day care may be a better choice…

Stupidity!  They just didn’t want to be bothered, and got caught…Throw away the key.

I can understand going in to pay for gas or running into the post office to check mail. This only takes a minute and one can still have full view of the vehicle. But Walmart??

Is this willful neglect or just plain stupidity?  I can’t think of a reason why both of them had to go into Wal-Mart for 10 minutes.

one person asked where was the mother i,m a 42 yearold grandfather my wife and i got custody of our grandson at night she don,t have to get out of bed i gets his milk etc. theirs no excuse for leaving a 5mo. baby in the car theirs no way they could have forgotten this baby this is very shamful for alie to be told this way and we need harder laws to protect our childrens after all our childrens didn,t asked to come here and to fail to support your childrens is a sign of weakness and shame.

Yeah I can remember being left in the car while mom ran in to pay the power bill etc. Since she surely didn’t want to carry four little ones in for two minutes. These’s no excuse for this at all! PURE STUPIDITY maybe!! Lord I thought two heads were better than one, but I was apparently wrong.

Times have changed. We were always left in the car and noone thought anything of it. In Fairhope everyone knew each other and would walk by and say hi to us by name. But leaving a five month alone is not smart in any town. How do you forget you have a baby, I don’t know. Thank God the child was found because it was cold this morning.
