Man who was arrested for the sexual abuse and attempted rape of his young step-daughter and bonded out both times has been arrested again. And this time, prosecutors say he will stay put.Derrick Ruggs was booked into Mobile Metro Jail just before 3:00 p.m. Tuesday. He was wanted for violating his probation in a separate case.
As News 5 first told you Monday, Ruggs was first arrested June 29th for allegedly trying to sexually assault his step daughter. He bonded out less than 24 hours later.
Investigators found enough evidence to charge Ruggs with attempted rape and arrested him again July 1st. He was released on bond the next day.
Rugg's wife says she was never notified that her husband was out of jail. She told News 5 she feared for her and her daughter's lives.
Prosecutor Steve Giardini says Ruggs should never have been released in the first place.
"The recommendation that the detective made on the form that she filled out to admit him to the jail, she recommended no bond until he saw a judge," Giardini said. "The jail did not honor that recommendation for whatever reason."
Prosecutors say the probation violation requires Ruggs' be held without bond.

Cocaine possession ( controlled substance ) is a class C felony and you do get a bond. Now if it is a trafficking charge…I think the bond is set at One Million. Which IMO is ridiculous. I agree that the bonds should change on Rapes and attempted rape….My personal opinion is that if it involves any sex crime…it should be no bond. But Im sure the ACLU would jump all over that.
