MOBILE, Ala. (AP) - A judge has ruled that ousted Clarke CountyCircuit Judge Stuart DuBose is mentally fit to stand trial on gun
charges and could be allowed to be out of jail until then.
U.S. District Judge Kristi DuBose also accepted the 51-year-old
Jackson man's not guilty plea Thursday and said U.S. Magistrate
Judge Bert Milling Jr. will decide whether to keep him in jail
pending trial.
Milling set a detention hearing for 1:30 p.m. Friday. Lawyers on
both sides agreed with a report by doctors who concluded DuBose
doesn't have a mental disease or defect. His trial is scheduled for
next month.
Dubose was arrested in May on allegations that he violated a
restraining order by possessing firearms. The Alabama Court of the
Judiciary removed DuBose from office on an ethics complaint.

the whole weapons charge seemed to be trumped up, although there is a huge part of the story missing i am sure. based on when he got released from rehab the first time, and that he was arrested at his doctors office, (i think it was a self imposed rehab then,) and the restriaing order being placed upon him when he was in rehab i am not sure he had time to vacate his premises and arrange for temporary custody of his gun collection with a friend, certainly never turn them over to the government you will never get them back. i hope he has his affairs and life in order now and can get on with the business of living his life. no matter what he is accused of he still has to live, and clarke county is all he knows. he shouldnt have to abandon his whole life. hope and pray he has gotten his act together and pray for the rest of the family, his wife, children, and didint i hear he has a grandchild now?
