Woman Awarded 750K In Shower Scalding

MOBILE, Ala. (AP) - A woman who suffered third-degree burns
after stepping into a shower of 136-degree water has been awarded
$750,000 in a settlement of a lawsuit against the apartment
manager.
The Mobile County court award to 25-year-old Treon Moorer, in
late June, followed mediation with JRS Management Inc. of Florida.
The company's lawyer, Larry Matthews of Pensacola, declined
comment.
Moorer's attorney, Richard Taylor, said the injury came at her
Shadow Oaks apartment in Mobile on June 10, 2007. She had been born
with a condition that causes frequent seizures, Taylor said, and
suffered one as a result of the shock of the burning water.
He said Moorer was "horribly scarred" from the neck down.
Taylor says the water heater industry and burn doctors recommend a
setting of 120 degrees.

If that was the case and she knew that there was problems with the hot water temp. and she knew what the extreme temps. would cause with her condition than I would think that using mostly cold with only a little hot would be the best way to go. Was it right for the apartment complex to not turn the water temp. down? No. However, if she already knew that it needed to be turned down than sticking one foot or hand in to start off with would be wise. Also I have learned that letting the water run out of the faucet for about 3 to 4 mins is also something that should be done because sometimes the hot water temp. can fluctuate for the first couple of mins. So sometimes when you first turn on the hot water and add cold water straight away it may not seem that hot, but they may just mean that the hot water has not reached it’s full temp. yet. I did this once running some bath water. Turned on the hot and cold and went into the living room to do something while the water ran. I can back and the water was steaming hot.

Explain the disability and how it influenced her decision to get into an extremely hot shower.  Or, explain how the water went from normal to extreme.

Just give us some details.

bamabob- right is right, wrong is wrong. you must know of anyone with this type of disability or any disability at all cause if you or anyone did then it wouldn’t be hard to explain. what ur saying is that everyone and anyone with a disability should stop doing the things that comes natural to the ones that are not disabled

roofermman - Your words sure do not help explain this one.  If she knew about the problem and asked to have it changed several times, then why in the world would she get in the shower without first testing the water?

This whole case sounds pretty strange, so some details have to be missing.

why hold it again the rest of us? your problem why make it anyone but yours? she knew of the hot water but chose to turn it on? she knew the risk but took it anyway? did she make this condision known before she signed the lease? there has to be more to it. i can’t see them rolling over for 750 large for nothing.

I notice that it’s easy for people to talk about only half of what they know. I just happen to know this woman and the story behind it, she asked the apartment manager several times to turn down the temperature because of her condition. Its not her fault about the condition that she and many others are born with, so why hold that against her.

OK, Question 1.) Did apartment personel sneak into this womans apartment during the day and turn the water heater setting up? 2.) Or was this her first time to take a shower/bath at this apartment to not know prior to the incident date that the water was to hot? 3.) Does she always just jump into hot water before checking it first to make sure its not to hot?

This lawsuit just sounds to set up to me, reminds me of the woman who burned her mouth with Mcdonalds Coffee.

don’t know about everybody else but if this had been me the only thing that got burned would be my foot, I seem to think everyone steps into the shower one foot at atime so when it burnt that first why the hell continue getting it the thing?????????

Must be a lot more to this story, because on the surface it doesn’t make a lot of sense.

I dont understand, just test the water. If it suddenly gets super hot either get out or turn the cold on.  Obviously she was a sick person, so why was she alone. Did she have a siezure in the shower prior?
