81-Yr Old Woman Will Not Stand Trial

City Attoney Lawrence Wettermark has dropped the charges against 81-year old Lula Mae Battle who was arrested for urinating in Bienville Square.

Mobile's city attorney is weighing in on the case of the 81-year old arrested for urinating in Bienville Square.

In June, Lula Mae Battle was trying to get across the square to the public restrooms and didn't quite make it. She jumped in the bushes to take care of business and ended up getting arrested and charged with public lewdness.

City Attorney Lawrence Wettermark says the police officer did his job but Battle will probably never go to trial. "That officer quite correctly issued the citation. Now, when it comes to the prosecutor's office we can look at it. If there was genuinely a misunderstanding or an accident, the city is not interested in prosecuting or pushing that kind of case."

Wettermark says he heard about the story on the news! He wishes that Battle or her defense lawyer would have contacted his office before taking the case to the media. Battle's lawyer Jay Casey tells us that he will be in touch with the city attorney to get the case sorted out.

As it stands right now, the trial is set for September 15th. If convicted, Battle could get up to a 500 dollar fine and 3 months in jail.

Surf, I agree with you.  In fact, had Ms. Battle been white she would’ve been allowed to use the restroom in the bank and we wouldn’t be having this discussion! Discrimination (of all types) happens every day whether we want to acknowledge it or not. It goes way beyond race discrimination. . .how about age discrimination? Believe me it happens!! Ms. Battle’s attorney is probably disappointed, as he let all this out to the media in hopes of “reaping” all the benefits.

The clown that put this case in the media has he taken this case pro bono, don’t think so, and he certainly knew who to contact in city attorneys office. Why did he not do so.

It is still somewhat mind boggling that some still think that the LE was to blame and shame shame on them for not having more compassion. It is understood that the woman had an accident. Yes we all have accidents of different measures. However, just because it was an accident does not make it legal. As suspected the case is not going to trial. So all this media frenzy was over nothing. Now this woman will forever be remembered as the woman who got arrested for peeing by a police substation. What this woman has been through has nothing to do with the police. It has to do with A. her attorney blasting her business all over the news without giving the whole story and B. The media reporting it without all the facts. So now even though this case no longer exist she is still going to have to deal with the aftermath of the media.

Just one more example of what we are all facing in the future. If a white person had been charged, number one, it would have NEVER gotten the media attention that it has, and number two, they would have been prosecuted. PERIOD. We all know it, some of us are just scared to say it, and the rest, “don’t want to offend”.

In all honesty,the charges would have probably been dropped anyway. Yet, an attorney chose to go to the media,instead of extending professional courtesy with the city attorney,by trying to hash it out behind closed doors first. The media, gives abbreviated accounts as to what happened,never checking with the city attorney (as per this report) to see what they were planning to do. A sweet old lady faces undue public humiliation for an “accident” that went national, and now everyone will whisper behind their hands when they see her. For what? Free advertising for her attorney? A “catchy” headline for the media to boost their hits for advertising. This lady was USED by her attorney and by the media.imo It is nice to know though,that there are OTHER media outlets that actually report without trying to become part of the news. Great job! (dripping with sarcasm)

You break the law you go to jail. thats just the way it is. If I peed in the square no matter what, how old,  I would go to jail.I thinkd it may be a matter of race.

I am happy that the charges have been dropped. Poor little lady has been through so much.

For the cadet that gave her the ticket….you will be 81 one day also. I hope if you have such a problem that someone will have more compassion for you than you did for this lady. I bet you didn’t even offer to get her clean clothes.

This is somewhat off topic, but you know that not a lot of places have facilities for changing infants or toddlers? It blows my mind how many places I have gone into that do not have anything to change my daughter on. When she was an infant it was not that bad because I could lay a changing pad in her stroller and change her there. However now that she is 2 that ain’t happening. I would think that any place that had a public restroom would be courteous enough to put something to change the little one on. The only time I go in public restrooms is in emergency situations. However, for someone who is not potty trained that is not so simple. I guess that is more incentive to potty train as quick as possible.
