"I remember blue lights, I remember pulling over. I remember him apologizing, he was a young kid," says Whetstone.
He says his blood alcohol level registered .13. The legal limit in Alabama is .08. After his arrest he was taken to the Foley Justice Center and later released to his family.
"Almost surreal like you were hoping that you would wake up and you were having one of those nightmares you have in your life and you wake up and it's still there." Whetstone says he doesn't want any special treatment. "I should not get out of it because I was the D.A. I should not be punished because I was the D.A.. I think they should treat me with justice, fairness and firmness as the case may be. And I hope no one thinks they are immune from this."
He says this will not be his defining moment. He will make something positive out of what he calls a "terrible mistake ". "Thank God I got stopped. Thank God I didn't hurt anybody."
Whetstone says he plans to plead guilty to the misdemeanor charge but they may have trouble finding someone to hear that plea.
The municipal judge and prosecutor in Summerdale both worked for Whetstone in the D.A.'s office.
