Troubles Continue For Bobby Wilson’s Family

Two setbacks and more legal hurdles face the family of Bobby Wilson this week. Wilson's gas station was burglarized early Tuesday morning, just two years after the well-known Spanish Fort businessman was robbed and attacked there. Spanish Fort Police Chief David Edgar tells News 5 the burglary does "not" appear to be related to the 2007 attack but says all angles are being investigated.

"Somebody broke in, smashed the front window and stole and undisclosed amount of money," says Edgar. "It's very upsetting to them. We spoke to them this morning and we're doing all we can to catch the perpetrator."

The burglary is just the beginning of more problems facing the Wilson's. News 5 has learned the attorney for Eric Buzbee, the man accused of killing Wilson, will a file a motion to dismiss the capital murder case Wednesday. Attorney John Beck says he will ask a judge to dismiss the charges against his client based on "double jeopardy"...a procedural defense that forbids a defendant from being tried twice for the same crime. Buzbee has been tried twice for capital murder. Both ended in mistrials.
