ATMORE, Alabama - An Atmore man says he is not a killer as he turns himself into the Escambia County, Alabama sheriff.

Bruce Day had been on the run for two days after a warrant was issued for his arrest on an eight year old case.

So, what brought this case back into the spotlight?

Since 2001, Woodrow "Token" Allen's family has looked for answers. Allen was set to testify against Day in a case but vanished before the trial. His body was never found.

The case of the missing man went nowhere until this week. Sheriff Grover Smith says they got new information about Allen's body. "We believe we know where it is and we will be attempting to recover the body." Smith wouldn't elaborate on any more details about the body.

On Tuesday, a murder warrant was being served on Day but he took off from a job site in Pensacola. Sheriff Smith says the hunt put the UWF campus on lockdown. "He decided to run and spent the night in the woods near the University of West Florida."

Thursday evening, the sheriff took a call from day's father. "He asked me to come to his house and come alone." When the sheriff got to the house, Day was waiting. "He was in the back of the house talking to his children. He was telling them bye before he went to jail. Bruce walked to the front and told me I'm ready to go. I just want you to know, I'm not a killer."

Day reportedly put the handcuffs on himself and sat up front on the way to jail. He's sitting in the Detention Center in Brewton under a 250,000 dollar bond.

Sheriff Smith says years ago, Day spent time in jail for shooting at Allen in his car.

I am confused. He had a trial in the Allen case and was found guilty for a lesser charge? Were they not able to convict him because the victim’s body was missing? Now that they may recover the victim’s body, Day would be able to stand trial again or for different charges?

sounds like he knew the cops were looking for him and wanted to see his kids and family before going to jail, after all he did turn himself in.I would probably try to find a good lawyer before turning myself in if in his situation,8 years is a long time to wait for an arrest.

Thanks for following this story. The information about Bruce Day comes from court records and the ECSO.

Offense Date Oct. 28, 2001 (attempted murder, shooting or discharging pistol into an occupied vehicle)

Allen last seen Dec. 13, 2001 and reported missing by his mom on Dec. 17th.

Day arrested Jan 4, 2002
Day indicted Feb 1, 2002

Sept 18. 2002, Day found not guilty of attempted murder and convicted of lesser charge of reckless endangerment. He served 1 year.

Obviously he has something to hide because he ran from the police when they tried to arrest him.  If you’re innocent then you’re innocent. Everyone is entitled to fair judgement, but you only make yourself look guiltier when you defy the law. Just stating my opinions.

Wow! WKRG, is this true? If so, you should be reprimanded for printing false information about someone.

Still not reporting accurately.  There were NO charges against Bruce Day at the time of Allen’s disappearance.  Allen went missing in 2001 and Day was charged in 2002, therefore Allen couldn’t have been a potential witness for the trial. Someone really needs to learn how what investigating reporting is all about.
