I do that when I’m behind someone that is driving like a fool (10 mph under the speed limit, drifting in the lane, etc) and I see that they’re on the phone. I figure, if they can’t hear the phone anymore, they’ll hang up and drive!

Any “Function” of your phone should be illegal when your “EYES” should be on the road.

I wonder if this will actually pass?

Innocent untill proven Guilty right?  The burden of proof falls in the lap of law enforcement.  Subpeona my cell phone records. I have 4 lines on the business account and 3 lines on the personal account.  Good Luck!  The second time I’m pulled over for this nonsense because I am performing a “legal” function on my phone I will file a harrasment suit.

Just another action to give law enforcement reasonable cause to pull over innocent people and disrupt their lives.

My husband and I call these IDIOT protection laws although it is usually protecting us against the idiots.  They are usually not the ones that get hurt when doing stupid stuff like this. 
Go Figure.

I think a better law might be that if you are operating a cell phone and get into an accident, you are automatically at fault or have to pay some kind of ticket… but again that is near impossible to prove or enforce.

This is rediculous.  So now I am going to be stopped and accused of texting any time that I perform any of the other functions on my phone.  I have a Blacberry, as many of us do.  I utilize it as a PDA, a web browser, an organizer, a scheduler, a media storage device, and a phone.  I lokk at it 1000 times a day.  I have reminders set for appointments and meetings.  I recieve emails, stock quotes, news and weather alerts.  How will any police officer know what function I am performing.  I will be the first to file a harrasment charge if I am pulled over every time an officer sees me utilizing my phone while driving unless he has substantial proof that I was sending text messages.  This law is absurd and I would love for someone in Montgomery to explain to us how they plan on enforcing this rediculous law.

The “texter” could challenge the ticket and prove it with the timeline from phone records. That is, if the phone Co. logs text times. They don’t show on my bill. Just the amount of texts. What I do when I encounter an obvious texter is LAY ON MY HORN. After a few of those from different people, they may do it less.

I think that there lies a real challenge here when it comes to writing citations for texting while driving… the burden of proof.
