Prichard Files For Bankruptcy

Alabama Prichard  NEW INFORMATION The city of Prichard files for bankruptcy one day before Mayor Ron Davis is scheduled to be depositioned in an ongoing pension dispute.

MOBILE, Alabama - Wednesday 9:30 a.m.
Prichard Mayor Ron Davis released the following statement Wednesday morning:

“I have looked at every opportunity available to obtain money to help fund the retirement plan for the City of Prichard. After careful review of all of our options, bankruptcy protection seems to be the only solution left at this time. Over the past 50 years, the pension plan was amended by the Legislature more than fifteen times, and always the economic burden on the City was increased. This has been a long term problem that was unfortunately inherited by this administration. After several lawsuits filed by pensioners, it has forced us to come to this decision, one that will protect the city and its residents. I hope that a solution can soon be found that will be fair to all. As Mayor, it is my duty to make sure that the City of Prichard continues to move forward by providing essential municipal services and to operate for the benefit of its citizens.”

Tuesday 6:45 p.m.The city of Prichard's financial troubles have hit rock bottom.

Late Tuesday afternoon the city filed for bankruptcy protection in Mobile County Circuit Court. The petition, which was filed at 4:54 p.m., comes one day before Prichard Mayor Ron Davis and Finance Director Rex Williams were scheduled to be depositioned in an ongoing pension dispute.

Robert Hedge, who represents more than fifty retired city workers in a lawsuit filed in August, says Mayor Davis is "playing games." Hedge says under the bankruptcy protection, the city gets an "automatic stay" on the pending litigation. "The whole thing is a creature of the Mayor," said Hedge. "This is not going to deter us."

Prichard city officials were not immediately available for comment.

Where are you Troy King? The democratic Mobile County D A offfice not going to do any thing about it. The federal judge ruled that the city must pay into the retirement fund and make it solvent but has not followed up on it to make make sure that they did. Why is every body afraid of Prichard? Could it be politics?

Hmmm…Interesting pattern. There always seems to be an issue or problem in Prichard. Murders in Prichard, robberies in Prichard, prostitution in Prichard, drugs in Prichard, corruption in Prichard, water and sewer issues in Prichard, previous bankruptcy in Prichard, failure to pay pensioners in Prichard, and now, bankruptcy in Prichard…again. What seems to be the root cause of so many problems here? This area is obviously only getting worse. It is regressing, not progressing. Perhaps something drastic needs to be done before Prichard becomes completely unsalvageable. Were there no audits of the city leaders while all of this was going on in regards to pension funds? Was there no ethics committee to oversee was what blatantly obvious? Time and time again Prichard has proven itself incapable of managing itself, much less growing itself in a positive manner. Yet, each time they seem to pull an “Ace in the Hole” and slither out of all responsiblity and consequence. This area continues to cast a bad shadow onto the surrounding communities, and I fear that it will only become worse as time goes forward. Bottom line is that the pensioners money went somewhere. There has to be a paper trail and I would be curious to see where (or to whom) it leads to…not that anyone would do anything about it. Once again, it would become a media circus and everyone would look the other way. The worst part is that these retired individuals will be the ones to suffer.

Why didn’t Prichard take advantage of RSA? Too much distance between the cash and greedy fingers?

Carl i sure hope noone would be that stupid(as to be paying in) I hope the mayor and financil people in Prichard get what is coming to them!!!!!!!!!!

There are already federal law suits in the works regarding this case,but the proper thing would have been to keep an eye on the account by those who hoped to count on this money for retirement.Depending on the type of retirement plan this one is,there are many things that can still be done.I’m entirely on the workers side and hope they get all that’s due them and maybe they will own Prichard before it’s over.It’s gonna be an uphill battle fighting our own legislature in Montgomery on these bankruptcy laws and the Feds but they have no other choice if they want to retrieve some of their funds.Wonder if they are still taking money from their workers for the retirement fund?

Well…thank goodness my family is not a victim in this or I would be upset, I guess!  It just makes me so mad to see this happen to those folks and others.  My husband and I joked the other day about how ones used to “joke” about not wanting a woman “pmsing” to be in charge.  Well…by golly…maybe it’s about time they let just that happen.  Turn a good ole’ female with hormone problems loose on some of these CROOKS and let her go at them.  Then see if any of them want to go before her again. lol [jmo]

Being a victim of bankruptcy laws, I truly sympathize with these many pensioners.

I just deleted my long personal heart-wrenching rant, as even after all these years it still hurts.

The ultimate blame for it was ... the state legislature ... as they wrote the current bankruptcy laws - and we are otherwise SOL.

that darn taloney girl is busy as all get out. the thomas trial, this, the da story. she probably has to book time in advance to relieve herself.

i agree completely lala but they stood by and watched carl ichan do it in the name of free market capitalism. the guilty get away with the cash and everyone else suffers.
