More Charges Tossed Out In Herman Thomas Trial

Alabama Mobile  Extortion and kidnapping charges against former judge Herman Thomas were tossed out Wednesday as the defense rested its case.

- The judge has dismissed all kidnapping and extortion charges. That leaves a total of 21 charges including sex abuse, sodomy, attempted sodomy and assault.

1:45 p.m.
- The defense rested its case without Herman Thomas testifying. "Cowboy Bob" Clark said there was no reason to call Thomas because Archbishop Oscar Lipscomb testified on his behalf.
- Prosecutor Nicki Patterson said she is always surprised when a defendant does not testify in his own defense.
- Closing arguments are scheduled to begin tomorrow at 9:00 a.m.
- The jury is expected to get the case after lunch.

Testimony continued in the sex trial involving former Circuit Court Judge Herman Thomas.

Thomas' wife, Linda, and twin teenage daughters listened in the courtroom as defense attorneys called several witnesses to testify about Thomas' character and reputation in the community.

Benjamin Harris, former Blount High School head football coach, was among the first to testify, saying Thomas tries "to help the kids stay in school and keep them off the streets." Harris testified he asked the former judge to speak to his students at least twice.

Another witness, Angela Shine, testified she and Thomas have been long-time friends since they were classmates at Booker T. Washington Middle School and Toulminville High School. Shine says she and Thomas have remained close friends. During her testimony, she told jurors about a phone call from one of the accusers, who was also friends with her nephew. Shine said the accuser told her he was about to "sing like a canary" during his Grand Jury testimony. Shine could not recall the approximate date of the phone, but said the accuser told her he would "tell them whatever they wanted to hear."

On cross examination, Chief Assistant District Attorney Nicki Patterson questioned Shine about the date of the call. Shine insisted she could not remember the year but said she believed it was recent. Patterson then told Shine the accuser was never brought in to testify to the Mobile County Special Session of the Grand Jury that indicted Thomas in March of this year. Patterson showed the witness a transcript of testimony from the federal Grand Jury where the accuser testified in 2006. "He did sing like a canary," said Patterson, who then pointed out that the testimony was before the allegations against Thomas were reported in the news media.

Shine, who was questioned on the witness stand longer than any of Wednesday's other witnesses, admitted Thomas paddled her nephew, who was in and out of jail on drug charges. Shine testified she and her mother asked Thomas to intervene with her troubled nephew. She said they did not specifically ask Thomas to paddle him and does not remember who suggested the paddling, but she testified they gave him permission.

Patterson then asked Shine if (named accuser) testified that he too was whipped by Thomas would she have any reason to believe it did not happen? Shine sat quietly and did not respond. Patterson responded, "no further questions."

Defense attorney Bob Clark said Wednesday morning he planned to rest their case this afternoon.

Herman Thomas is facing 52 felony charges including sodomy, sex abuse, extortion and kidnapping.

Sounds as if he has wasted a lot of money on defense attornys all he needed was this judge.

This story reflects how ingrained “whooping” is in Alabama’s culture. What other state not only shields schools from lawsuits over paddling injuries but also exempts teachers from child abuse statutes (as long as it’s not their own child they’ve beaten)?

If Thomas were a school principal, he could spank young men on a regular basis—legally and with the community’s support. Making them drop trou for the punishment might cross an unspoken line, but I defy anyone to cite a law or policy that it categorically violates. Besides, predators can tell which kids’ll be too intimidated to refuse such an order, or easily manipulated into going along with it, or even conditioned to accept it because they get the same treatment at home.

Victims would likely be too humiliated and self-blaming to tell anyone before until considerable time has passed, accusations would seem belated, and it seems easiest to just try to move on. And if a teacher was found out giving some bare-butt paddlings, the district would typically circle the wagons to defend him (absent less ambiguous forms of sexual abuse—to which spanking is sometimes a gateway).

Subverting discipline is easy when most parents are clueless about sexually abusive spanking and don’t warn kids about adults who may have bad reasons for wanting to spank them. I recall an elementary teacher in Brewton, AL was part of a child spanking pornography ring busted in 2002. Lucky he wasn’t a paddler at that school. (ref: http://www.nospank.net/101.htm)

If he is so innocent.. why not take the stand and say so. explain this stuff…?????

CAuse he is guilty as sin

Hmmmmm.  Ok, so I can believe either:

(a). A judge who liked to wear a bowtie, drove a pink Lexus, and liked to spank grown men had a creepy sex fetish and manipulated and abused the system in order to act on it – OR-

(b). Several grown black men conspired to bring public attention to the fact that they bent over for a man to spank their bare butts while he was erect, subjecting themselves to public mockery and embarrassment, all to get even with the system- not by conspiring against the white DA who prosecuted them or the cops who arrested them- but the black judge who repeatedly pulled strings to reduce their sentences and tried to help straighten them out. 

Yeah, I’m gonna go with (a).

And they got out of their jail cells,without supervision,to go anonymously “deposit fluids,” HOW? Pretty far-fetched there….but then I don’t have a criminally disenfranchised mind either.

Don’t let the DNA in the room fool you. It is more likely that the gentelemen involved placed the DNA in the room, with nobody else present, and as an act of rebellion and defiance against the system. It plays out better than than a middle finger towards the system. Think of the glory of being the one that deposited fluids in that fashion, in that location, and what an act of defiance and achievement it was. If you don’t have the mind set of a disinfranshised criminal, it will not make sense. If you look at it from their perspective, it was a real great accomplishment. Can you just hear them bragging- Let me tell you what I did and where I DID IT.

I think if the prosecution pulls out a paddle,gets a young convict before Hermie, and then the presiding judge orders “all rise,” that will tell the whole story.lol Just a thought….

Don’t know this many or any of his accussers but I can tell you that the way this case of falling apart doesn’t look good for the prosecution.

Dismiss all charges, one by one. Let the truth come out that they are just here to ruin the man’s reputation.
