
The Alabama Supreme Court has denied Bob Ingle's request to dismiss the case against him.
Ingle, who was arrested in December 2006, hoped the charges would be dropped after the alleged victim in the case, 11 year old Rebecca McEvoy, died in a car crash in January 2007.
But, the state's highest court says private conversations Rebecca had with a young friend, as well as the testimony of a doctor and nurse will be allowed during the trial.
"I think given the circumstances we're given we're in as strong as a posture as we could hope for now," says Assistant District Attorney Steve Giardini.
Rebecca's family, who has fought hard to bring attention to the case, says they are relieved by the Supreme Court's decision. "We're just so happy now that we have found out the trial is coming," says Theresa Jordan, Rebecca's cousin. "We've been waiting for a long time. Even Rebecca was waiting while she was still here."
The trial is scheduled to begin March 30th.
