Deaf Man’s Family Disappointed

Dollar General Antonio Love  An internal investigation found that Mobile Police were right for tasing a deaf man and wrong for arresting him.

The tasing of a Mobile man at a Dollar General store last month made international headlines and it probably will again after Mobile Police released findings from their internal investigation.

Chief Phillip Garrett believes the tasing of Antonio Love was justified but the arrest after was not. Love is deaf and mentally-disabled.

Police responded to the Azalea Road store after getting a call from the manager. He claimed that a man had been inside the restroom for an hour.

Six officers responded to the store that day but only the supervisor-in-charge has been put on administrative duty for making the call to arrest love. Lieutenant Kevin Rodgers is now facing a disciplinary hearing to determine if he will get in any trouble or even fired for his role that day.

Chief Garrett will take those findings to Mayor Sam Jones and they will decide the outcome.

Garrett held a press conference to discuss the case. "I'm sorry that we've had an incident involving Mr. Love. I wish we had not. I wish that the outcome had been different. The supervisor, who I do hold responsible, made a decision based on what was going on at the time. I don't agree with the decision."

Police have also released the names of the other officers involved.

Officer Bryan Mims
Officer Carlos Walton

The Love family retained a lawyer named Tommy James. He released this statement.

"Birmingham attorney Tommy James of the firm Morris, Haynes & Hornsby has been retained by the family of Antonio Love, the deaf and mentally challenged man who was pepper-sprayed and tased by Mobile police officers in the bathroom of a Dollar General store in Mobile. “I was only recently retained by Antonio’s family and have not yet been able to review the Internal Affairs investigation, the 911 tapes or the video surveillance tapes from the Dollar General store. However, Mobile Police have indicated that they are not going to voluntarily release the Internal Affairs investigation. We have requested the 911 tapes from the Mobile Police Department and they have refused to provide them to us even though they provided them freely to local media. We have also requested the
surveillance tapes from Dollar General and they have not yet responded to our request.”

“Antonio and his family are very disappointed with the findings of the Internal Affairs investigation. It is clear that what happened to Antonio should have never happened. He has never had any run-ins with the law and he was not a threat to anyone. Once Antonio realized that it was the police trying to get into the bathroom, he put up no resistance and yet police still tasered him three times. Even after discovering that Antonio was hearingimpaired and had a diminished mental capacity, the police still arrested and charged him.” “It is puzzling as to why the police were even called in the first place simply because a person was allegedly in the bathroom for too long and not causing any problems.

Another mystery is why the store manager or police did not simply use a key to enter the restroom. It is also interesting that it took six officers approximately fifty minutes to gain access to the restroom.” James stated that his investigation is in its very early stages and that the family would have no further comment at this time. “We are going to do everything that we can to gather all information and conduct a very thorough investigation. It is very important for us to obtain the Internal Affairs investigation, the 911 tapes and any surveillance tapes in and outside of the Dollar General showing the incident.”

The family has not made a final decision as to whether or not they are going to file a lawsuit in this matter. “I was retained to thoroughly investigate this matter and to find out for the family what really happened. The family has not made a final decision on whether they will file a lawsuit. We are just trying to get all of the facts as to what really happened to Antonio and why it happened and then we will go from there. However, we may be forced to file suit so that we can issue subpoenas to obtain the Internal Affairs investigation and other relevant documents because the Mobile Police are not willing to release this
information to us.”

Dear Tamika, no being deaf is not a crime, duh I know this as I am partially deaf myself but allowing a person who has a mental capacity of a seven yr old out by themselves should be… Most of my fully deaf friends usually frequent the sames stores where the employee’s know them, but not only that there are ways to sign to let a person know your stomach is upset. We even have a deaf guy who comes into our store in the morning and brushes his teeth before his ride comes and picks him up.. We all know what he is doing and don’t call the cops.. The family says that this guy goes to this DG all the time so it makes you wonder why the employee called the cops and not 911.

to lutawolf being deaf doesn’t mean u can’t go out by yourself just mean u can’t hear his stomach could have been upset so by him being deaf not a crime and someone was knocking that means he couldn’t hear them also not a crime now if there is a crime please point it out to me and i will apologize forthis comment

Go ahead and take away the tasers and guns. Do away with cops all together. Let the criminals run amok. Eventually they will kill each other and everyone else and the problems of society will solved.

Honestly what was the guy doing in the bathroom for over an hour?? yeah he is disabled but how did the cops know that besides all that, just because someone is disable does not mean that they are not Perverted, how in the world were the DG employees or the cops to know better.. Instead of blaming other ppl the family needs to take a good look at themselves and recognize that they are the main ones responsible for letting a mentally disabled man who can’t take care of himself out on his own, he had no business being in that store without someone to supervise him.. if you let a child run loose in the store is the child suddenly the DG and Cops responsibility? Should he have been arrested, no but that’s been owned up to now if only the family could be as honest and own up to there part in the mess.

So logically they go to the next thing. The tazer. As for the whole parents letting 7 year old’s run the street. Well just because it is being done does not mean that it is safe or the logical thing to do. This is not the first case of a impaired or disabled adult that was out on his or her own and had run in’s with the law. It is not safe for the individual or others. I do not know about you, but I was not able to even go out in a group of friends until I was 13 and even then was only allowed to go to the skating rink were there was constant adult supervision. At 7 or even 10 years old I was not allowed to be out on my own. Like I have stated before. I am not saying that his parents should be with him 24/7, but there are other forms of supervision that does not seem as overbearing to the individual. Say a close family friend. Just someone that can be in the same area as him so that if something was to occur, there would be no miss communication.

I can understand how tazers can be fatal, but that does not mean every time one is used that is as violent as some make it out to be. I am sure it hurt the man like h** when it happened, but he was released within hours of the incident. Did not have to get checked in to a hospital. Was in the same health, as he left his house in, when the interview was taken. Anything can become a lethal weapon if you intend to use it that way. If they wanted to kill him they could have used the baton. If you have such health conditions that might not go well with a tazer the best thing to do is to try not to be put into a situation were it might be used. Just because you have an encounter with LE does not mean you are going to get tazed. Co-operate and you should be fine. As for this case. They used verbal commands first, subject could not understand. So they use bodily force by trying to open the door. He keeps trying to stop them. So they use pepper spray. Does not work.

i am against them because I have seizures. I am scared I will be tased for no reason. that is not how i want to die. Yes they do tase you for nothing. if you don’t believe me read the article above. if you get shot in the leg or something like that you won’t die. you can still die from a taser!!! i don’t think they should be outlawed I just think they should be a last resort.

I don’t know why eveyone thinks his family doesn’t care about him.

Yeah. Take away the tazers so that the only options that they have are pepper spray, baton or their gun. That sounds like a reasonable solution. Because people are always known to better survive a gunshot wound than getting tazed.

his family did not care where he was untill now, they can smell that dollar.they are the ones at fault,they let this kid with a ten year old brain run the streets,then when something happens to him they holler lawyer,shame on them.

I don’t think cops should be able to use tasers. They can kill you just like guns. I would rather be shot than tased.
