Bobby Wilson’s Family Lashes Out At D.A.

SPANISH FORT, Alabama - Bobby Wilson's daughter voiced her frustration and disappointment in the not guilty verdict in the Eric Buzbee capital murder case and directed it to Baldwin County District Attorney Judy Newcomb.


"We feel the DA not being there to try this case actually hurt this case," says Tracey Goens. "This was a very important case in this county, my dad was a very important person and I just feel she should've been there to have a voice for us."


Goens says Assistant District Attorney Michael Pylant and his team of investigators did a great job handling the complex capital murder trial, but says DA Newcomb should have taken charge and prosecuted Eric Buzbee. But Newcomb was absent at all three trials.


"That hasn't set well with me," says Goens. "There was a second trial, where was she? The third trial? She should have been there on the seat next to the prosecutor."


Goens still believes Buzbee killed her father and says it will be a while before she accepts the verdict. The Wilson family is trying to put the robbery and murder that happened here in 2007 behind them and move on, but without closure, the family says moving on will be difficult.


Newcomb insists Buzbee killed Wilson but says the ultimate decision was up to the jury.


The Wilson's say they will not file a civil suit against Buzbee.

adj) acquitted, not guilty (declared not guilty of a specific offense or crime; legally blameless) “he stands acquitted on all charges”; “the jury found him not guilty by reason of insanity”


the definition applies to “criminal innocence” not actual innocence. whether he did it or not, i don’t know, but just because they don’t prove guilt in the courtroom doesn’t mean it doesn’t exist.

When the verdict was read, they said “not guilty” that means innocent.

The problem does no lie with Eric Buzbee; the problem was with the investigation and the fact that there was no evidence that linked Buzbee to the crime scene or the crime scene to him.

Whose DNA was under Mr. Wilson’s fingernails? It 100% excluded Eric Buzbee. If, Eric Buzbee was “so high on drugs he would have done anything for money to buy them” how on earth did he go in that store, commit such a brutal crime and leave no evidence behind and take absolutely none with him.

The people who said that Buzbee was upset about Mr. Wilson not cashing his check. The prosecution’s witness said to begin with on tape that it was Sunday, the day after the attack. Does not make sense, IF Buzbee had done it. After listening to the recorded interview where he was prompted that it was Friday, there was a major problem with that too. Supposedly, Buzbee had not even gone in to TRY to cash the check yet. Hmmmmm…... even more inconsistency that leads to the innocense of Buzbee.

Those are just a few of the issues that come to mind immediately. I, as a juror, and a moral and ethical person could NOT find someone guilty of a capital crime with testimony such as the above mentioned. And that is only 2 of the major issues than immediately come to mind. You have to remember there are many, many more than this that came up during the 3+ weeks of the first trial.

Yes and they didnt have enough evidence to prove he was guilty. So back to my original comment, either they didnt do there jobs or he really is innocent

just because you are acquitted does not mean you are innocent, it just means they did not prove the case beyond a reasonable doubt…...

Southfan, you are right, the instructions given to the jurors are very specific. There was not enough evidence to convict Buzbee of the crime. From the evidence I heard during the first trial, I was CONVINCED he did not do it. With the evidence that has surfaced since the first trial, I am positive he didn’t do it.

This does not change the fact that the Wilson family deserves justice. Justice is blind (supposedly) and the system was created to prevent travesties of misjudgement. It is a good thing that we have laws that protect us and our rights, otherwise, anyone could have anyone else point a finger and say “they did it” and then the vigilante type of justice I read on this site earlier today would have them hung from a tree in the center of the courthouse square.

The DA tried this case 3 times, one of which didn’t get started good before the prosecution asked for a mistrial. They simply did not have the evidence to convict Eric Buzbee. Their timeline did not work. With Mr. Wilson on blood thinners, it happened later and pushed their timeline way out of balance leaving the evidence they were using to convict Eric in essence proving his innocense.

My sense of justice and fair play makes me abhor seeing people say Buzbee did it after he was acquitted. It is a travesty that due to the DA’s refusal to admit they made a mistake that the real killer continues to walk our streets.

I dont think it would’ve mattered if the DA tried it herself, the evidence wasnt there!

SFALresident, be aware that people who have not served on juries are ignorant. They have no idea the instructions you were given regarding the evidence you heard. They are ignorant about how our justice system has to protect the accused as well as the victims. It’s a balance. Note the lady of justice being blindfolded with the scales.

This isn’t CSI Spanish Fort, folks. Get real.

Curiousone, did I detect a threat in your post? To me, that is unacceptable and what is it that makes what you said any different from the attack on Mr. Wilson. Violence begets violence.

There was no evidence that convinced jurors of Buzbee’s guilt. He was acquitted. He is innocent. It is just plain wrong that threats are being made against someone who our legal system upheld to be INNOCENT!

Curious you are idiot, did you hear any of the evidence? The DNA was not Buzbee’s… SFAL you are right and wasn’t a juror just what was out for the world to see.. I think they need to look at Family and some of the other 13 suspects!!!!!!!!!!!

Wrong again carebear…..I am not a Wilson Family memeber. Mr. Wilson was a friend of mine and I trade at his station. It is a shame that the only justice this family will get is knowing Eric will have to live the rest of his life being the man that got away with killing Mr. Wilson. Always looking over his shoulder, wondering if someone will come up from behind and do the same thing to him. I know the buzbee family too….and dont think it will bother them too much. They been living with their family reputation a long time too. As for this insanity person….I’m lost there. One last thought…....your really stupid if you think I’m the only one with this opinion…..dream on.
