Accuser Describes Paddling, Sex Abuse In Thomas Trial

Alabama Mobile  Testimony continued Wednesday with the third accuser back on the stand telling jurors about paddling and sexual abuse at the hands of former judge Herman Thomas.

MOBILE, Alabama - Testimony continued Wednesday with the third alleged victim back on the stand. The 26-year-old told jurors about letters he wrote to Mobile County Circuit Court Judge Herman Thomas while he was incarcerated at Mobile Metro Jail.

In one of the letters, which have not yet been admitted into evidence, the accuser told Thomas he knew the judge was under investigation, but he hoped Thomas would "help him" before he resigned.

"Whatever you need me to do, I swear I'll do it," said the accuser, who admitted he believed he would get paddled again. The accuser told jurors he was whipped multiple times with a belt and fraternity paddle, which he described as a long, brown paddle with holes in it and red and white fraternity letters.

The accuser told jurors he had a pending case before Judge Thomas and the judge told him "a lawyer would do you no good in my courtroom." He says he often visited with Thomas in private, and described one incident when he was riding in the car with Thomas. "He grabbed my penis, and I pushed his hand away," said the accuser, who testified Thomas told him he loved him.

On cross examination, defense attorney Bob Clark told the accuser "you try to tell everybody what they want to hear to help yourself out," referring to how the accuser was able to repeatedly get out of jail. "You knew how to play the system," Clark said, but the accuser quickly responded saying, "I wasn't playing the system, the system was playing me."

Clark insists Thomas never responded to the accuser's letters.

The accuser's mother took the stand next, telling jurors her son told her about the alleged sexual abuse, but she admitted she didn't believe him at first. "He told me Judge Thomas liked to spank people," she told jurors. "He was telling me he took him to another office that he had. Then, he'd encourage them to pull his clothes down."

During the mother's testimony, she told jurors Thomas helped her get a job at Mobile Metro Jail. While working at the jail, she noticed Judge Thomas often showed up at the jail and picked up inmates. "He would come in the docket area. Someone from the docket area would get a defendant and bring them to him," she testified, admitting she grew increasingly suspicious.

The mother then began taking notes, documenting when she would see Thomas at the jail. In her notes, which she read aloud in court, she named four inmates, including one of the accusers. She said Thomas picked each of them up from the jail between December 2003 and October 2004.

The mother said she confided in a co-worker about the statements her son had made to her earlier, but the co-worker told Judge Thomas what she said. The mother testified Thomas then confronted her about the allegations and told her "he'd never help her son again."

Late Wednesday afternoon, prosecutors called the fourth accuser to the stand. The alleged victim, 26, testified he was repeatedly paddled while he was on probation under Judge Thomas. He described multiple paddlings, including one occasion when he noticed Judge Thomas' "private area" was exposed.

The accuser, who is much shorter than the judge, said when he turned around during the paddling, the judge pushed his head, forcing the accuser's mouth to touch the judge's genitals. The accuser said he immediately grabbed his clothes and ran out of the room.

Thomas pleaded not guilty to more than 70 felony counts including sodomy, sexual abuse, kidnapping and extortion. All fourteen accusers are expected to testify during the trial.

Thomas stepped down from the circuit court bench in October 2007 as the allegations first started to surface.

Looks like Cowboy Bob plans to make his whole defense based upon Joe Kulakowski as some mastermind of a conspiracy.

Would a lawyer risk his reputation and career by recruiting a bunch of repeat offenders.  Would he be dumb enough to trust them to keep quiet about such a thing?  I don’t think so…..

You are right about that one.  People with that many kinks never change, except maybe to escalate the behavior.  I would consider him to be dangerous, if the accusations are true.

In fact, someone needs to go back and look at every case he adjudicated.  How many guys out there have extended sentences, because they would not play along with the sadistic “b word?”

Hmmmm… We’ve got a guy who uses his power to manipulate and sexually assualt young men. He loses his office, so he loses his power to control them.  Does his sadistic compulsion just magically go away overnight?  Um, most likely not. He was previously willing to risk everything he had to satisfy it. Is he one of the small percentage of sex offenders who magically reform themselves? 

He’s not a big dude, and he’s not going to get away with bullying young prisoners anymore, so he’s going to have to find new prey even weaker than him.  Hmmm.  He sure does like to tutor teenage students.  Probably no connection there, right? 

In fact, he’ll probably go on to become an upstanding citizen.  Just because he used our justice system like a private sex party and made a mockery of the public’s trust in the judiciary doesn’t make him a bad dude, right?  Nah.  Just let him get on with his life.  He can retire and enjoy all the money he made off of the taxpayers while he was abusing his office and acting like it was some sort of bare bottom buffett.

Just let him go, Tyson.  That’ll make Mobile look awesome!  Go after the “real” bad guys.  You know, the kids with the string of misdemeanor drug and theft charges.  They can always earn their way out with a spanking, right?

If these charges are true, this is far more than two adults engaging in consensual behavior.  This would be a clear abuse of power and obstruction of justice.  This guy was playing with peoples lives for his own amusement.

Detestable!

This is an embarassing case for Mobile. Tyson needs to make this go away. So Thomas did or did not do the things he’s accused of. These were grown men who had broken the law,and they allowed whatever did or did not happen to happen.Did he actually let any dangerous criminals out of jail? I doubt it. He’s lost his credabilty and his job. It’s evened out as far as I’m concerned. Let it go.

If I was on the jury, her actions would have a negative effect on me.  She has no business snatching anything in that courtroom!

Fox10 just reported that as one of the acussers left the stand, Mrs. Thomas “snatched” a document from his hand. This resulted in concern on the part of the prosecution that a mistrial could be declared based on the effect such displays might have on the jury.

I’m wondering who among those who still believe this is a frame job (including a substaintial number of his fraternity crew) will take the stand to defend his charecter. Rumor has it that even after these charges were filed, he escorted some young men on a trip sponsored by Kappa despite concern about how it might look.

My sister & her boyfriend were trying to decide what to be for halloween. Jokingly, I said one of you could be a prisoner & the the other HERMAN THOMAS!!! lol.
