81-Yr Old Urinates in Park

Downtown Mobile Bienville Square  An 81-year old woman is arrested for urinating in Bienville Square. She says she couldn't make it to the restroom fast enough.

She's 81-years old and could go to jail for urinating in Bienville Square.

Back in June, nature called after Lula Mae Battle paid a visit to her bank in Downtown Mobile. They didn't have a public restroom and Battle says she couldn't make it to the restroom on the other side of the square fast enough. "I was trying to make it across the road. All of them cars coming that way..and I couldn't get across, and I urinated on myself. I was wet. All my shoes and everything were wet", says Battle.

So, the 81-year old jumped in some nearby bushes to relieve herself. It just so happened that the bushes surrounded a Mobile Police substation. She was arrested and charged with public lewdness. Battle says, "I was crying, please don't put me in jail. Please don't put me in jail. I was crying".

Mobile Police won't comment on the case but tell us that Battle's trial is set for September. Battle is out on bond until that trial.

By then, Battle will be 82-years old.

Defense lawyer Jay Casey has a lot to say about what happened to his client. "She says she was apologetic and tried to explain what had happened. This situation is just an old lady that couldn't control herself. I'm sure in the past there's been problems with people abusing the system but this isn't it. You know when people get to that age, they're worried about going to jail and worried about what people may think of them. She is actually worried about going to jail."

Public lewdness is a Class C misdemeanor and could get Battle up to 3 months in jail and a 500 dollar fine. Casey plans to ask the judge to throw out the case.

"I've never been in jail in my life. First time I've ever been in jail in my life, cause I always went to work, back home and church...back home and church. And, I couldn't make it, I tried to make it. I tried to make it. I couldn't make it", says Battle.

I hope that the woman or at least a family member understands that. No matter what age you are an incident such as this one never gets any less embarrassing. Maybe her story will bring more awareness to businesses having public restrooms available in their facilities. Sure maybe a bank feels that no one individual would be in there long enough to have to use the facilities, but this woman’s story could possibly bring out the fact that some people have problems that cause them not able to make a 10 minute trip without having to use the facility. There are many scenarios that could have been played into that could have prevented this from happening. Sometimes when people are put in a situation such as this one they are faced with a split second decision and sometimes are not always able to make the best choice. Does this make them bad people? Not necessarily.  I guess that some places do not see bladder control issues as an excuse to have public facilities, but seeing the aftermath of what can happen if the issue is not addressed hopefully opens their eyes a little bit more.

Cops are heroes.  They’re the first people I call when I’m in trouble, that’s for sure.  But they are also human and do things we don’t like.  We complain about it on the internet because that’s what people do. 

I’m wasting my time blabbering on about my opinion mostly for Lula Mae’s sake.  I know most people aren’t used to being on the news and the whole family likes to read the stories and comments to see what people think.  It broke my heart to see that poor lady on TV saying she was going as fast as her little legs would take her and she wet all over herself.  And hearing her say she begged to not go to jail… Wow. 

She should have had on some sort of protection, sure.  But maybe she was making a 10 minute trip and had never had an emergency come on so suddenly.  Maybe she made a mistake and forgot. 

Lula Mae, you’re a grown woman who’s possibly put in many good years of kindness.  It’s not my job to judge you or tell you when you should wear Depends.  I’m sure you’ve learned your body’s limits, or a relative or friend will help you from now on and make sure you’re taken care of.  Keep your head up!  Personally, if I had to choose between turning my head and covering my kids’ eyes to protect their delicate sensibilities, or you having to stand there and wet yourself to avoid offending me, I would ask you to duck in the bushes every time.  I’d stand in front of you to block the view to protect your sense of dignity. You’re not going to go to jail, dear.

I do not think that you understand the double standard here though. Not saying that is necessarily from you, but some of the same people that argue over the silly crimes being pursued are some of the same ones that say the cops slack and do not do their jobs. As for this woman’s case, If she did not pee right beside the police substation, chances are the police would not have to have seen, without avoiding, her peeing in public. Considering how many people are in that park during the day plenty of people saw what occurred. Also the fact that there have been huge problems in that area with people urinating in public adds to the reasons of her arrest. I am sure all the homeless people there would have seen her get off with a warning and found that a good way to get quick pay next time they got arrested for the same thing. It is very sad that this woman’s picture and embarrassing moment is being plastered all over the news, but again you can not blame that on LE. Lovepeace, your argument is somewhat reasonable.  You are not ranting about how that one arrest took away from them catching some serial killer. I would hope that my husband takes his job seriously no matter what the offense is. That he does not just let things slide for the sake of the media and what the people he works so hard to protect think of what he did.

The judge should throw this out.  The lady does not deserve to serve ANY time or fine for this.  She merely had an emergency and it’s terrible that there was no where for her to go.  Bad situation to be in.  And to make this public is humiliation.

Everything will likely turn out fine for this lady (assuming she was telling the truth).  The cop WAS just doing his job, and it’s the judge’s job (at a bench trial) to decide the facts and how to apply the law.  I don’t think the cop should be in any trouble whatsoever, but I do wish I didn’t have to pay for such a silly trial.  And I’m not getting all the arguments that giving the cops the discretion to make allowances for some of life’s little “oops” moments will lead to total chaos and penises being waved around all over town.  The police have been allowed to use discretion for as long as I can remember, and it’s always seemed to work out before…

You know, the cops just do their job. There is an ordinance, its not up to them to decide the law. We have judges to decide we don’t need to punish an old lady but we the people can punish a bank for humiliating an old lady by writing letters.

You guys are entitled to your opinion, and the rest of us are entitled to say that we wish the police could use the small degree of discretion that they ARE given.  The justice system depends on police as the first line of judgment, using common sense to avoid clogging up the system with laughable offenses that will most likely be dismissed, wasting everybody’s time and money. 

All I ask is that if any of you who believe in strict interpretation of the law at all times, with no allowances for common sense or kindness, hold yourself to those standards at all times.  If you are ever caught jaywalking, or slightly speeding on the interstate, or running through a light as it turns red (and note that I said IF, I’m not saying that you’d ever break a law), and the officer is kind enough to cut you some slack and let you go with a warning, please be sure to demand your ticket.  If you’re pulled over for momentarily taking off your seat belt to deal with a spilled drink, demand your ticket.  If you have ever downloaded an MP3 file without paying, turn yourself in.  If you reach in your pocket to pull something out during a stroll and inadvertently drop a gum wrapper, demand to pay the littering fine.  If your dog slips out of his leash and runs in the road, pay up. 

This goes for our kids too.  If you let them stay out of school for a random, rare fun day, ask for a truancy charge.  If they get in a fight at school, demand assault or disorderly conduct charges…

The presidents solution will just be a round of beers, which will cause more “urges”.

It is obvious that once people get on a certain mindset that any knowledge or information that anyone tries to give is irrelevant. I have tried, and many others, to explain why this arrest would not interfere with the bigger crimes quite a few times, but that keeps getting either ignored or not understood. Next time one of these people that are not doing their jobs save your, or someone you knows life remember to ask them how many “insignificant” arrest were made that same day. Have a good and safe day with your kids.
